JUSTICE R.M. DOSHIT)<\/p>\n<p>\t Rule<br \/>\nreturnable today. Learned advocates Ms. Archana Raval and Mr.<br \/>\nDilip B. Rana appear for and waive service of rule on behalf of the<br \/>\nconcerned respondents.\n<\/p>\n<p id=\"p_1\">\t This<br \/>\npetition under <a href=\"\/doc\/1712542\/\" id=\"a_1\">Article 226<\/a> of the Constitution has been<br \/>\npreferred by the nine societies [hereinafter referred to as,  the<br \/>\nSocieties ] which are members of the Karjan Cooperative<br \/>\nCotton Sales, Ginning &amp; Pressing Society Limited,  a specified<br \/>\nsociety within the meaning of Section 145-B [c] read with<br \/>\nSection 74-C of the Gujarat Cooperative Societies Act, 1961<br \/>\n[hereinafter referred to as,  the Act ].\n<\/p>\n<p id=\"p_2\">\t Pursuant<br \/>\nto the election programme declared for the aforesaid Karjan  Society,<br \/>\nthe Societies had sent names of their delegates to be included in the<br \/>\nelectorate. The said names were accepted by the Election Officer. The<br \/>\nnames of the said delegates were included in the provisional list of<br \/>\nvoters. Feeling aggrieved, the respondents nos. 5 to 9 lodged<br \/>\nobjection against inclusion of the delegates of the Societies in the<br \/>\nlist of voters. The said objections were considered by the Election<br \/>\nOfficer. By impugned order dated 5th September,<br \/>\n2008, the said objections were upheld. The delegates of the<br \/>\npetitioner-Societies have been ordered to be removed from the voters&#8217;<br \/>\nlist. Feeling aggrieved, the Societies have preferred the present<br \/>\npetition.\n<\/p>\n<p id=\"p_3\">\t  It<br \/>\nappears that in respect of the Societies, by Orders made by the<br \/>\ncompetent authority, the concerned managing committees have been<br \/>\nsuperseded and an administrator has been appointed as envisaged by<br \/>\nSection 81 of the Act. The grievance of the objectors was that the<br \/>\ndelegates sponsored by the Societies were selected by the managing<br \/>\ncommittees which are superseded. The said delegation was, therefore,<br \/>\nnot legal and valid. Such delegates could not have been included in<br \/>\nthe voters&#8217; list.\n<\/p>\n<p id=\"p_4\">\t  It<br \/>\nis not in dispute that the concerned managing committees have been<br \/>\nsuperseded and an administrator has been appointed. It is also not in<br \/>\ndispute that except for the petitioner no. 8-Malod Vividh Karyakari<br \/>\nSahakari Mandali Limited, the names of the delegates were selected by<br \/>\nthe managing committee of the concerned society. The said action of<br \/>\nthe managing committee of the concerned society was later on ratified<br \/>\nby the general body by its resolution passed in the month of June,<br \/>\n2008.\n<\/p>\n<p id=\"p_5\">\t Mr.\n<\/p>\n<p id=\"p_6\">Mehta has appeared for the petitioners. He has submitted that  19th<br \/>\nMay, 2008 was the last date for sending the names of the delegates of<br \/>\nthe member-societies. He has relied upon rule 5 of the Gujarat<br \/>\nCooperative Societies Election to Committees Rules, 1982. In the<br \/>\nsubmission of Mr. Mehta, the said rule 5 allows a member society to<br \/>\nchange the name of its delegate upto the sixth day before the date<br \/>\nappointed for making nominations.  The action of the managing<br \/>\ncommittees of the Societies having been ratified by the general body,<br \/>\nupto the sixth day before the date appointed for making nominations,<br \/>\nthe delegation made by the Societies was valid. The names of  such<br \/>\ndelegates ought to be included in the voters&#8217; list.\n<\/p>\n<p id=\"p_7\">\t  Mr.\n<\/p>\n<p id=\"p_8\">Nanavati has contested the petition. He has referred to certain<br \/>\nresolutions and the information submitted by the Societies. He has<br \/>\npointed out the discrepancies  in the alleged  dates of the meetings<br \/>\nof the managing committees of the societies, the dates of the<br \/>\nresolutions, etc. He has submitted that such discrepancies make the<br \/>\ngenuineness of these resolutions doubtful.\n<\/p>\n<p id=\"p_9\">It is not in dispute that the names of the delegates were<br \/>\nselected by the managing committees which are superseded by order of<br \/>\nthe competent authority. Such managing committees are, therefore,<br \/>\nnon-est  in eye of law. Any action taken by such managing<br \/>\ncommittees are equally non-est.  The delegation made by the<br \/>\nmanaging committees of the Societies was without the authority of law<br \/>\nand was non-est in the eye of law. Subsequent ratification of<br \/>\nsuch decision by the general body would not legalize the illegal<br \/>\naction of the managing committees. The said lacuna could not<br \/>\nhave been filled-in by resorting to the power to change the names of<br \/>\nthe delegates conferred by the aforesaid Rule 5. We are, therefore,<br \/>\nof the opinion that the impugned decision of the Election<br \/>\nOfficer does not warrant interference; except for the petitioner no.<br \/>\n8-Malod Vivid Karyakari Sahakari Mandali Limited.\n<\/p>\n<p id=\"p_10\">For the aforesaid reasons, the petition is partly<br \/>\nallowed. The impugned order dated 5th September,<br \/>\n2008 passed by the Election Officer is set-aside in respect of<br \/>\nthe petitioner No.8-Malod Vividh Karyakari Sahakari Mandali Limited.<br \/>\nFor the rest of the petitioner-Societies, the said order is<br \/>\nconfirmed.\n<\/p>\n<p id=\"p_11\">\t   Rule<br \/>\n is made absolute in the above terms.
