Justice K.T.SANKARAN\n\n Dated :25\/03\/2010\n\n O R D E R\n                          K.T.SANKARAN, J.\n             ------------------------------------------------------\n                      B.A. NO. 1678 OF 2010\n             ------------------------------------------------------\n             Dated this the 25th day of March, 2010\n\n\n                                O R D E R\n<\/pre>\n<p id=\"p_1\">      This is an application for anticipatory bail under <a href=\"\/doc\/1783708\/\" id=\"a_1\">Section 438<\/a> of<\/p>\n<p>the Code of Criminal Procedure. The petitioners are accused Nos.2<\/p>\n<p>and 3 in C.R. No.31 of 2010 of Excise Range Office, Kattappana,<\/p>\n<p>Idukki District.\n<\/p>\n<p id=\"p_1\">\n<p id=\"p_2\">      2. The offence alleged against the petitioners is under <a href=\"\/doc\/390591\/\" id=\"a_1\">Section<\/p>\n<p>55(a)<\/a> and (i) of the Abkari Act.\n<\/p>\n<p id=\"p_3\">\n<p id=\"p_4\">      3. The prosecution case is that on 7.3.2010, the first accused<\/p>\n<p>was found engaged in the sale of Indian Made Foreign Liquor in the<\/p>\n<p>tea shop run by accused Nos.2 and 3. On seeing the Excise party,<\/p>\n<p>accused No.2 ran away. It is also alleged that accused No.3 had<\/p>\n<p>entrusted the Indian Made Foreign Liquor to accused No.1.<\/p>\n<p id=\"p_5\">      4. The learned counsel for the petitioners put forward his<\/p>\n<p>arguments in great detail. He read the whole of the mahazar and the<\/p>\n<p>occurrence report and tried to pick holes in the same to support the<\/p>\n<p>B.A. NO. 1678 OF 2010<\/p>\n<p>                                    :: 2 ::\n<\/p>\n<p id=\"p_6\">argument that the petitioners are thoroughly innocent. At this stage,<\/p>\n<p>when the question is whether anticipatory bail is to be granted to the<\/p>\n<p>petitioners, it is not proper to consider the facts so meticulously to<\/p>\n<p>arrive at a conclusion whether the petitioners are guilty of the<\/p>\n<p>offence.    The question to be considered is whether, there are<\/p>\n<p>materials, prima facie, to connect the petitioners with the offence<\/p>\n<p>alleged against them. On a perusal of the case diary, I am satisfied<\/p>\n<p>that there are, prima facie, materials to connect the petitioners with<\/p>\n<p>the offence. The contention raised by the petitioner is a matter for<\/p>\n<p>evidence and proof at the time of trial. That cannot be done at this<\/p>\n<p>stage.\n<\/p>\n<p id=\"p_7\">\n<p id=\"p_8\">       5.  The offence alleged against the petitioners is grave in<\/p>\n<p>nature. This is not a fit case where anticipatory bail can be granted<\/p>\n<p>to the petitioners.
