JUSTICE AJAY KUMAR MITTAL.\n\n\nPRESENT: Mr. Gurcharan Dass, Advocate for the petitioner.\n\n              Mr. Harvinder Singh, Advocate for the respondents.\n\n\nAJAY KUMAR MITTAL, J.\n<\/pre>\n<p id=\"p_1\">              In this revision petition filed under <a href=\"\/doc\/1331149\/\" id=\"a_1\">Article 227<\/a> of the<\/p>\n<p>Constitution of India, challenge is to the order dated 15.12.2008<\/p>\n<p>(Annexure P-1) passed by the Additional Civil Judge (Senior Division),<\/p>\n<p>Ludhiana, whereby the evidence of the petitioner has been closed by<\/p>\n<p>the order of the Court.\n<\/p>\n<p id=\"p_1\">              Counsel for the petitioner submitted that in the interest of<\/p>\n<p>justice, one opportunity may be granted to the petitioner to lead her<\/p>\n<p>entire evidence and the respondents can be compensated by way of<\/p>\n<p>costs. He further submits that the petitioner will conclude her entire<\/p>\n<p>evidence at her own risk and responsibility on the date to be fixed by<\/p>\n<p>the trial court.\n<\/p>\n<p id=\"p_2\">              After hearing learned counsel for the partes and in the facts<\/p>\n<p>and circumstances of the present case, this Court is satisfied that in the<br \/>\n<span class=\"hidden_text\" id=\"span_1\"> C.R. No. 2049 of 2009                                    -2-<\/span><\/p>\n<p>interest of justice the petitioner deserves to be granted one opportunity<\/p>\n<p>to conclude her entire evidence. Accordingly, the revision petition is<\/p>\n<p>disposed of with a direction that the petitioner shall be granted one<\/p>\n<p>opportunity to lead her entire evidence on the date to be fixed by the<\/p>\n<p>trial court at her own risk and responsibility and subject to payment of<\/p>\n<p>Rs.3,000\/- to the respondents as costs.
