NO. 4462 of 2007\n                ==========================\n              Dated this the 13th day of December, 2007.\n\n\n                                 ORDER\n<\/pre>\n<p id=\"p_1\">       The petitioner, who is the 2nd accused in C.C. No. 291\/2005 on<\/p>\n<p>the file of the Chief Judicial Magistrate, Ernakulam which originated on<\/p>\n<p>the basis of a charge sheet filed by the Central Police Station,<\/p>\n<p>Ernakulam for offences punishable under Sections 406 and 420 r\/w<\/p>\n<p><a href=\"\/doc\/37788\/\" id=\"a_1\">Section 34<\/a> and <a href=\"\/doc\/1897847\/\" id=\"a_1\">120B<\/a> IPC, challenges the order dated 30.10.2007<\/p>\n<p>passed by the Magistrate refusing to discharge the revision petitioner.<\/p>\n<p id=\"p_1\">       2. The case of the prosecution is that the 1st accused availed a<\/p>\n<p>loan of Rs.6 lakhs on 31.08.2002 from Sree Ram Investments Ltd.,<\/p>\n<p>for purchasing a vehicle and hypothicated the same with the financier<\/p>\n<p>and the 2nd accused (revision petitioner) was the guarantor to the said<\/p>\n<p>transaction and subsequently the two accused persons hatched a<\/p>\n<p>criminal conspiracy and in furtherance of their common intention they<\/p>\n<p>sold the vehicle and misappropriated the sale proceeds without<\/p>\n<p>repaying the loan taken from the de facto complainant.<\/p>\n<p id=\"p_2\">       3.   The learned counsel appearing for the revision petitioner<\/p>\n<p>submitted that charge witness Nos. 2 and 3 have not stated that the<\/p>\n<p>revision petitioner had joined hands with the 1st accused for the<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">CRL.R.P. NO. 4462\/2007             : 2:<\/span><\/p>\n<p>clandestine sale of the vehicle and the misappropriation of the sale<\/p>\n<p>proceeds and that the aforesaid two charge witnesses only presume<\/p>\n<p>that the revision petitioner also would have been a privy to the secret<\/p>\n<p>sale of the vehicle. In the light of the statement of CW2 to the effect<\/p>\n<p>that both accused Nos. 1 and 2 were jointly cheating the financiers, it<\/p>\n<p>is too early to accept the petitioners&#8217; contention that there was no<\/p>\n<p>material against the revision petitioner so as to frame charge. What<\/p>\n<p>is necessary is only a prima facie case or a probable case. Hence, I do<\/p>\n<p>not feel constrained to interfere with the order passed by the Chief<\/p>\n<p>Judicial Magistrate. There is no reason the why the petitioner should<\/p>\n<p>not stand trial and attempt to secure an acquittal.<\/p>\n<p id=\"p_3\">      This revision is accordingly dismissed.\n<\/p>\n<p id=\"p_4\">\n<p id=\"p_5\">                                          V.
