            This is a petition under Section 439<\/a> Cr.P.C. for grant of regular<\/p>\n
bail in case FIR No. 112 dated 13-5-2007 (Annexure P-1) registered at PS<\/p>\n
Sadar Khanna, district Ludhiana, under sections 302<\/a>\/148<\/a>\/149<\/a> now under<\/p>\n
sections 304<\/a>\/325<\/a>\/341<\/a>\/201<\/a>\/120-B<\/a>\/148<\/a>\/149<\/a> IPC. Law was set in motion on<\/p>\n
recording the statement of Jarnail Singh who has stated as under :-<\/p>\n
            “Libra came to the police station along with his elder<\/p>\n
            brother Enos and told that our father had been living in<\/p>\n
            village Libra for the last about 25 years. We both brothers<\/p>\n
            were also living with him at the tubewell of Darbara Singh<\/p>\n
            at village Libra. Land of Mohinder Singh Libra who is<\/p>\n
            nephew of Darbara Singh is near the tubewell of Darbara<\/p>\n
            Singh which is on lease with Gurmail Singh son of Mohan<\/p>\n
            Singh, resident of village Bharpurgarh, presently,<\/p>\n
            resident of Khanna. As such, we know Gurmail Singh, his<\/p>\n
            son Harinder Singh and their servant Nikka Singh.<\/p><\/blockquote>\n
\n
            On 11-5-2007, we all the three, i.e. Our father and we both<\/p>\n
            the brothers were working in the fields of Darbara Singh<\/p>\n
            as daily wagers. After loading wheat husk in the tractor

           trolley from other fields, we along with his servant Kala<\/p>\n
           had brought the same to the tubewell where we had been<\/p>\n
           living. Kala left for home after parking the tractor trolley<\/p>\n
           there. Me and my brother Enos were unloading the wheat<\/p>\n
           husk from the trolley. My father    was sitting with us in<\/p>\n
           front of our house (Kotha) under the light of electric lamp.<\/p>\n
           At about 8 pm, Harinder Singh along with his servant<\/p>\n
           Nikka came to us on their tractor 5911 and asked whether<\/p>\n
           the wheat husk has been unloaded from the trolley and<\/p>\n
           we replied that not as yet and we are in the process of<\/p>\n
           unloading it. At this both of them started hurling abuses.<\/p><\/blockquote>\n
\n
           My father asked them not to abuse, whereupon they<\/p>\n
           started quarreling with my father. We scolded them and<\/p>\n
           they went back along with the tractor. After about \u00bd-3\/4<\/p>\n
           hour, Harinder Singh along with his father Gurmail<\/p>\n
           Singh, servant Nikka Singh and Jit Singh son of Lakhvir<\/p>\n
           Singh residents of village Dheero Majra,Bhalwan name of<\/p>\n
           whose village is not known and 2\/3 unidentified persons<\/p>\n
           whom I can identify on coming before me came there on<\/p>\n
           tractor and motor cycles. They were armed with Danda<\/p>\n
           (sticks) and hockey sticks. All the abovesaid persons<\/p>\n
           opened an attack on my father. Within our sight, Gurmail<\/p>\n
           Singh, Harinder Singh and their servant Nikka Singh, gave<\/p>\n
           repeated blows with their hockeys and sticks (dandas) on<\/p>\n
           the head, arms and chest of my father. When we both<\/p>\n
           brothers alighted from the trolley and tried to rescue our<\/p>\n
           father, then Harinder Singh asked his companions to<\/p>\n
           catch hold of these “Salle Bhayian”. On this, Jit Singh,
\n Crl Misc 31543-M of 2008                                   –3–\n<\/p>\n
           Bhalwan and other unidentified persons encircled us and<\/p>\n
           Jit Singh gave 2-3 danda blows, which hit on my right arm,<\/p>\n
           right leg and left ear and Bhalwan gave danda blows on<\/p>\n
           my brother Enos, which hit on his arms and legs. Gurmail<\/p>\n
           Singh, Harinder and Nikka Singh kept inflicting injuries<\/p>\n
           upon my father within our sight. We raised alarm Marta-<\/p>\n
           Marta and made request to them that we are migrants and<\/p>\n
           that we would leave the place. After beating us, they left<\/p>\n
           from there along with their weapons on their tractor and<\/p>\n
           motorcycles. Since it was dark and we are migrants, we<\/p>\n
           got asleep. Yesterday i.e. 12-5-2007, on account of my<\/p>\n
           father in pain, we brought Dr.Gian of village Libra to the<\/p>\n
           tubewell for providing medicine to our father and he<\/p>\n
           advised us to take our father to the Civil Hospital, Khanna.<\/p>\n
           Then, after taking Baljinder Singh Sardar Libra with us<\/p>\n
           took our father to Civil Hospital, Khanna for getting him<\/p>\n
           treatment. On seeing the condition of my father, the<\/p>\n
           doctor referred him to Rajindera Hospital, Patiala and<\/p>\n
           yesterday i.e. 12-5-2007, my father died in hospital at<\/p>\n
           Patiala and his dead body is lying in the hospital. Being<\/p>\n
           migrants and since it was night time, we both the brothers<\/p>\n
           have come to village Libra today. After informing our<\/p>\n
           employer, we have now come to the Police Station to<\/p>\n
           lodge the report. The cause of enmity is that we are<\/p>\n
           migrants from Bihar and we restrained them not to hurl<\/p>\n
           abuses to us. They all have beaten us. Due towhich my<\/p>\n
           father has died. Action may kindly be taken. LTI Zanual,<\/p>\n

                  Thereafter the present applicant and Harjit Singh moved<\/p>\n
Criminal Misc 9084-M of 2008 decided on 7-5-2008 for grant of anticipatory<\/p>\n
bail and the High Court accepted that application and it was ordered as<\/p>\n
under :-\n<\/p>\n
            “In view of the aforesaid, without meaning to express any<\/p>\n
            opinion on merits, the instant petition is allowed.<\/p>\n<\/blockquote>\n
                  In the event of arrest, the petitioners shall be<\/p>\n
            released on bail on furnishing bail bonds to the<\/p>\n
            satisfaction of the arresting officer subject to the<\/p>\n
            conditions specified in Section 438(2)<\/a> of the Code of<\/p>\n
            Criminal Procedure.\n<\/p><\/blockquote>\n
                  Meanwhile, the petitioners are directed to join<\/p>\n
            investigation on 19-5-2008 at 10 am and continue to do so<\/p>\n
            as and when required to do so.\n<\/p><\/blockquote>\n
                  The instant order shall remain effective till one<\/p>\n
            month after the filing of the charge sheet by the police or<\/p>\n
            till the disposal of the regular bail petition of the<\/p>\n
            petitioners, whichever is earlier.”\n<\/p><\/blockquote>\n
The petitioner thereafter moved an application for grant of regular bail and<\/p>\n
the same was dismissed by the Additional Sessions Judge vide order<\/p>\n
dated 20-11-2008 observing that challan has not yet been presented.<\/p>\n
However, the learned State counsel was fair enough to concede that<\/p>\n
challan was presented on 21-10-2008 i.e. prior to the passing of the order<\/p>\n
dated 20-11-2008. While making discussion, this High Court observed that<\/p>\n
SP Detective held enquiry and submitted enquiry report Annexure P-1<\/p>\n
exonerating the petitioner. It is transpired that complainant as well as his<\/p>\n
brother namely Yunus, the star witness for the prosecution has given<\/p>\n
affidavit exonerating the petitioner.   However, that report of the SP<\/p>\n
Detective was not accepted and challan was presented. Even according to
\n Crl Misc 31543-M of 2008                                           –5–\n<\/p>\n
the contents of FIR, no injury has been attributed to the applicant-<\/p>\n
deceased. The injury attrributed to the applicant is only to the complainant<\/p>\n
which was declared grievous later on.\n<\/p>\n
             Keeping in view the totality of circumstances that petitioner has<\/p>\n
been allowed concession of anticipatory bail by this Court on 7-5-2008 and<\/p>\n
keeping in view the statement of complainant and his brother resiling from<\/p>\n
their earlier statements and also keeping in view the fact that the petitioner<\/p>\n
has not been attributed any injury to the deceased, the application for grant<\/p>\n
of bail stands accepted.\n<\/p>\n
             Bail to the satisfaction of the trial Court.\n<\/p>\n
