JUSTICE ABHILASHA KUMARI\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 12\/05\/2009 \n\n \n\n \nORAL\nORDER<\/pre>\n<p id=\"p_1\">Rule.\n<\/p>\n<p id=\"p_1\">\tMr.L.B.Dabhi, learned Additional Public Prosecutor, waives service<br \/>\n\tof notice of Rule on behalf of the respondent-State of Gujarat.\n<\/p>\n<p id=\"p_2\">This<br \/>\n\tapplication, under <a href=\"\/doc\/1290514\/\" id=\"a_1\">Section 439<\/a> of the Code of Criminal Procedure,<br \/>\n\thas been filed by the applicants with a prayer to enlarge them on<br \/>\n\tbail in connection with FIR, being C.R.No.II-81\/2009 registered with<br \/>\n\tKadi Police Station, for offences punishable under <a href=\"\/doc\/445276\/\" id=\"a_1\">Sections 498(A)<\/a>,<br \/>\n\t<a href=\"\/doc\/445276\/\" id=\"a_2\">504<\/a>, and <a href=\"\/doc\/989759\/\" id=\"a_3\">114<\/a>,<a href=\"\/doc\/1569253\/\" id=\"a_4\"> of the Indian Penal Code<\/a>.\n<\/p>\n<p id=\"p_3\">The<br \/>\n\tallegation against the applicants, who are the husband,<br \/>\n\tfather-in-law and mother-in-law of the complainant is that, they are<br \/>\n\tinvolved in the commission of the above-mentioned offence.\n<\/p>\n<p id=\"p_4\">Mr.S.K.Gadhvi,<br \/>\n\tlearned counsel for the applicants, has submitted that the<br \/>\n\tapplicants are innocent and have been wrongly implicated. That the<br \/>\n\tnarration in the FIR will go to show that the allegations levelled<br \/>\n\tagainst the applicants are of a general nature and there is no<br \/>\n\tmaterial on record to substantiate the same. That the complainant<br \/>\n\thas herself admitted that she was not subjected to cruelty and the<br \/>\n\tonly allegation is that the applicant No.1 was not talking with her<br \/>\n\tproperly.  That taking into consideration the aspect that the<br \/>\n\tapplicants are permanent residents of the address mentioned in the<br \/>\n\tcause-title and will not abscond, tamper with evidence or intimidate<br \/>\n\twitnesses, and will abide by any conditions that may be imposed by<br \/>\n\tthe Court, the application may be favourably considered.\n<\/p>\n<p id=\"p_5\">On<br \/>\n\tthe other hand, the learned Additional Public Prosecutor, has<br \/>\n\tstrongly opposed the grant of bail to the applicants.\n<\/p>\n<p id=\"p_6\">I<br \/>\n\thave heard the learned counsel for the respective parties, perused<br \/>\n\tthe averments made in the application, contents of the FIR and other<br \/>\n\tdocuments on record. Considering the entire material on record,<br \/>\n\tprima-facie, the involvement of the applicants in the commission of<br \/>\n\tthe above-mentioned offences, in the manner alleged, is not clearly<br \/>\n\tborne out from the record. As it is not likely that the applicants<br \/>\n\twill abscond, tamper with evidence or intimidate witnesses, the<br \/>\n\tapplication deserves to be allowed. It is, accordingly allowed.\n<\/p>\n<p id=\"p_7\">The<br \/>\n\tapplicants are ordered to be released on bail, in connection with<br \/>\n\tFIR, being C.R.No.II-81\/2009 registered with Kadi Police Station, on<br \/>\n\ttheir executing the personal bond of Rs.10,000\/- (Rupees Ten<br \/>\n\tThousand Only) each with one solvent surety of the like amount to<br \/>\n\tthe satisfaction of the trial Court and subject to the conditions<br \/>\n\tthat they shall:\n<\/p>\n<p id=\"p_8\">(a)\tnot  take  undue<br \/>\nadvantage  of  their liberty or abuse their liberty in any manner;\n<\/p>\n<p id=\"p_9\">(b) \tnot act in a manner injurious to the interest of the prosecution and not tamper with the evidence or intimidate the witnesses;\n<\/p>\n<p id=\"p_10\">(c)\tmaintain law and order and cooperate  the investigating officers;\n<\/p>\n<p id=\"p_11\">(d) \tnot leave the local limits of  State  of  Gujarat without  the  prior  permission  of the concerned Sessions Judge.\n<\/p>\n<p id=\"p_12\">(e) \tmark their presence  before  the Investigating Officer of the concerned police station on 15th and 30th  day of every month of the English calendar year, any time between  10.00  A.M. to 5.00  P.M. till the commencement of trial.  The Investigating Officer will ensure the presence of a senior lady Police Officer, at all times when the applicant No.3 marks her presence;\n<\/p>\n<p id=\"p_13\">(f) furnish  the addresses of their residence to the Investigating Officer and also to the Court at the time of execution of  the bond  and  shall  not  change  their residence without prior permission of this Court;\n<\/p>\n<p id=\"p_14\">(g) \tsurrender  their Passport, if any, to the trial Court within a week;\n<\/p>\n<p id=\"p_15\">In<br \/>\n\tcase breach  of  any  of  the  above conditions is committed, the<br \/>\n\tconcerned Sessions Judge will be free to issue warrants or take<br \/>\n\tappropriate action in the matter.\n<\/p>\n<p id=\"p_16\">Bail<br \/>\n\tbefore the lower Court having  jurisdiction to try the  case.  It<br \/>\n\twould be open to the trial Court concerned  to give time to furnish<br \/>\n\tthe solvency certificate, if prayed for.\n<\/p>\n<p id=\"p_17\">It<br \/>\n\tis made clear that no observation made by this Court  be construed<br \/>\n\tas having any bearing on the merits of the case, at the time of<br \/>\n\ttrial. The trial Court will proceed in accordance with law,<br \/>\n\tunaffected and uninfluenced by any observation contained in this<br \/>\n\torder.\n<\/p>\n<p id=\"p_18\">Rule<br \/>\n\tis made absolute.
