DAVE\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 04\/08\/2011 \n\n \n\n \n \nORAL\nORDER<\/pre>\n<p id=\"p_1\">1.\tRule.\n<\/p>\n<p id=\"p_1\">Learned APP Ms.M.L.Shah waives service of notice of Rule for<br \/>\nrespondent &#8211; State.\n<\/p>\n<p id=\"p_2\">2.\tIt<br \/>\nis submitted that the allegation in the complaint are of the incident<br \/>\nwhich took place before 8 years and the amount was due to the<br \/>\ncomplainant, since he was member of the money circulation scheme<br \/>\nfloated by the accused.  Now the issue is settled between the<br \/>\nparties.   It is further<br \/>\nsubmitted that the applicants have roots in the society, will not<br \/>\nflee from justice and will cooperate with the investigation as and<br \/>\nwhen called for. It is further submitted that in view of the above,<br \/>\nthe applicants may be granted anticipatory bail.\n<\/p>\n<p id=\"p_3\">3.\tHeard<br \/>\nLearned APP for the respondent &#8211; State.\n<\/p>\n<p id=\"p_4\">4.\tHaving<br \/>\nheard learned counsel for the parties and perusing the record of the<br \/>\ncase and taking into consideration the facts of the case, nature of<br \/>\nallegations, role attributed to the accused and punishment,<br \/>\nprescribed for the alleged offences and  without discussing the<br \/>\nevidence in detail, at this stage, I am inclined to grant<br \/>\nanticipatory bail to the applicants. This Court has also taken into<br \/>\nconsideration the law laid down by the Apex Court in the case of<br \/>\n<a href=\"\/doc\/1108032\/\" id=\"a_1\">Siddharam<br \/>\nSatlingappa Mhetre v. State of Maharashtra &amp; Ors<\/a>. reported in<br \/>\n[2011] 1 SCC 694,<br \/>\nwherein, the Apex Court reiterated the law laid down by the<br \/>\nConstitutional Bench in the case of Shri<br \/>\nGurubaksh Singh Sibbia &amp; Ors. reported in [1980] 2 SCC 565.\n<\/p>\n<p id=\"p_5\">5.\tLearned<br \/>\nCounsel for the parties do not press for further reasoned order.\n<\/p>\n<p id=\"p_6\">6.\tIn<br \/>\nthe result, this application is allowed by directing that in the<br \/>\nevent of the applicants herein being arrested pursuant to FIR being<br \/>\nCR No.I &#8211; 218 of 2011  with Palanpur   Police Station for the<br \/>\noffences punishable under <a href=\"\/doc\/988620\/\" id=\"a_1\">sections 406<\/a>, <a href=\"\/doc\/1436241\/\" id=\"a_2\">420<\/a>, <a href=\"\/doc\/1128948\/\" id=\"a_3\">120(B)<\/a>   of the Indian<br \/>\nPenal Code, the applicants shall be released on bail on furnishing a<br \/>\nbond of Rs.10,000\/- (Rupees Ten Thousand only) each with one surety<br \/>\nof like amount on following conditions :-\n<\/p>\n<p id=\"p_7\">[a]\tshall<br \/>\ncooperate with the investigation and make themselves  available for<br \/>\ninterrogation whenever required;\n<\/p>\n<p id=\"p_8\">[b]\tshall<br \/>\nremain present at concerned Police Station on 10.8.2011  between<br \/>\n11.00 am to 2.00 pm;\n<\/p>\n<p id=\"p_9\">[c]\tshall<br \/>\nnot hamper the investigation in any manner nor shall directly or<br \/>\nindirectly make any inducement, threat or promise to any witness so<br \/>\nas to dissuade them from disclosing such facts to the Court or to any<br \/>\nPolice Officer;\n<\/p>\n<p id=\"p_10\">[d]\tshall<br \/>\nat the time of execution of bond, furnish their address to the<br \/>\nInvestigating Officer and the Court concerned and shall not change<br \/>\ntheir residence till the final disposal of the case or till further<br \/>\norders;\n<\/p>\n<p id=\"p_11\">[e]\twill<br \/>\nnot leave India without the permission of the Court and, if is<br \/>\nholding a Passport, shall surrender the same before the trial Court<br \/>\nimmediately.\n<\/p>\n<p id=\"p_12\">[f]\tIt<br \/>\nwould be open to the Investigating Officer to file an application for<br \/>\nremand, if he considers it just and proper and the concerned<br \/>\nMagistrate would decide it on merits.\n<\/p>\n<p id=\"p_13\">[g]\tdespite<br \/>\nthis order, it would be open for the Investigating Agency to apply to<br \/>\nthe competent Magistrate, for police remand of the applicants. The<br \/>\napplicants shall remain present before the learned Magistrate on the<br \/>\nfirst date of hearing of such application and on all subsequent<br \/>\noccasions, as may be directed by the learned Magistrate. This would<br \/>\nbe sufficient to treat the accused in the judicial custody for the<br \/>\npurpose of entertaining application of the prosecution for police<br \/>\nremand. This is, however, without prejudice to the right of the<br \/>\naccused to seek stay against an order of remand, if ultimately<br \/>\ngranted, and the power of the learned Magistrate to consider such a<br \/>\nrequest in accordance with law. It is clarified that the applicants,<br \/>\neven if, remanded to the police custody, upon completion of such<br \/>\nperiod of police remand, shall be set free immediately, subject to<br \/>\nother conditions of this anticipatory bail order.\n<\/p>\n<p id=\"p_14\">7.\tAt<br \/>\nthe trial, the trial court shall not be influenced by the prima facie<br \/>\nobservations made by this Court while enlarging the applicants on<br \/>\nbail.\n<\/p>\n<p id=\"p_15\">8.<br \/>\n  Rule made absolute.
