The Deputy General Manager,\n    Stressed Assets Management Branch,\n    State Bank Building,\n    157-A, Anna Salai 8th Floor,\n    Chennai - 600 002.\n\nR4 and R5 impleaded as party respondents as per the\norder of this Court  in M.P(MD)No.1 of 2010 in\nW.P(MD)No.1714 of 2005, dated 20.10.2010\t  ..Respondents.\t\t\t\t\n\nPrayer\n\nWrit Petition filed under <a href=\"\/doc\/1712542\/\" id=\"a_1\">Article 226<\/a> of the Constitution of India,\npraying this Court to issue a Writ of  Mandamus directing the first respondent\nto effect revenue recovery proceedings as per the certificate issued by the\nthird respondent in G.O(D)No.404, dated 12.04.2004 immediately.\n\n!For Petitioner  ... Mr.T.Murugan\n^For Respondents ... Mr.D.Muruganandam\n    1,3 and 4\nFor Respondent-2 ... No appearance\n\n:ORDER\n<\/pre>\n<p id=\"p_1\">\tThe prayer made in this Writ Petition is for issuance of a writ in the<br \/>\nnature of Mandamus, directing the respondent No.I to proceed with the<br \/>\napplication filed by the petitioner under <a href=\"\/doc\/1774629\/\" id=\"a_1\">Section 33(C)(1)<\/a> of the Industrial<br \/>\nDisputes Act for recovery of the amount as ordered by the learned Labour Court.\n<\/p>\n<p id=\"p_1\">\t2.  It is not disputed that respondent No.I  has no jurisdiction to<br \/>\nrecover the awarded amount  due to the bifurcation of the District, and the<br \/>\nproceedings  are to be taken up by the District Collector, Sivagangai District.\n<\/p>\n<p id=\"p_2\">\t3. Nothing has been placed on record to show as to whether the petitioner<br \/>\nhas filed any application under <a href=\"\/doc\/1774629\/\" id=\"a_2\">Section 33(c)(1)<\/a> of the Industrial Disputes Act<br \/>\nwith the District Collector, Sivagangai District, or any application has been<br \/>\nmoved to the District Collector, Madurai to transfer the application to the<br \/>\nDistrict Collector, Sivagangai District.\n<\/p>\n<p id=\"p_3\">\t4. In absence of approaching the competent authority with appropriate<br \/>\napplication, no Writ of Mandamus  can be issued  by this Court. It is well<br \/>\nsettled law that before approaching the High Court for issuance of Writ in the<br \/>\nnature of Mandamus, it is prerequisite to first file a Writ of demand, showing<br \/>\nlegal right and corresponding obligation of authority to redress the grievance.\n<\/p>\n<p id=\"p_4\">\t5. Accordingly, the Writ Petition is dismissed, with liberty to the<br \/>\npetitioner to take steps to move for transfer of  application from District<br \/>\nCollector, Madurai to District Collector, Sivagangai District  or to move a<br \/>\nfresh application before the District Collector, Sivagangai District, for<br \/>\nrecovery of the awarded amount.
