MUKHERJEE, FAIZAN UDDIN\n\n\n\n\nACT:\n\n\n\nHEADNOTE:\n\n\n\nJUDGMENT:\n<\/pre>\n<p id=\"p_1\">\t\t\t O R D E R<br \/>\n     These appeals  by special leave arise from the order of<br \/>\nthe Division  Bench of\tthe Allahabad High Court made on May<br \/>\n20, 1976  in W.P.  Nos. 792\/75\tand 5032\/75  and batch.\t The<br \/>\nappellant  challenged,\talong  with  yet  other\t batch,\t the<br \/>\nvalidity of the notification published under Section 4(1) on<br \/>\nOctober 12,  1974 and  declaration  under  Section  6  dated<br \/>\nSeptember 28,  1974 contending\tthat the  declaration  under<br \/>\nSection 6  could not  be made  until the  notification under<br \/>\nSection\t 4(1)\twas  published\t in  accordance\t  with\tlaw.<br \/>\nTherefore, the\tnotification is\t bad in law.  The High Court<br \/>\nnoted, as  a fact,  that the notification under Section 4(1)<br \/>\nand the\t declaration under  Section  6\twere  simultaneously<br \/>\npublished on  October 12,  1974.   There is  no bar  no\t the<br \/>\nGovernment making  the\torder  that  before  publication  of<br \/>\nSection 4(1)  declaration under\t Section 6  should  also  be<br \/>\npublished.   It is  not in  dispute that  the State  had  in<br \/>\nexercise of its power of eminent domain under Section 17 [4]<br \/>\nof the Act, dispensed with the enquiry under Section 5A.  It<br \/>\nis  settled   law  that\t  simultaneous\tpublication  of\t the<br \/>\nnotification under  Section 4(1)  and the  declaration under<br \/>\nSection 6 was valid in law prior to the coming into force of<br \/>\nthe <a href=\"\/doc\/1210757\/\" id=\"a_1\">Amendment  Act<\/a> 68  of 1984.\t  It  is also  seen that  in<br \/>\nrelation to  the State\tof Uttar  Pradesh, Land\t Acquisition<br \/>\n[Amendment] Act 5 of 1991 has been brought into force w.e.f.<br \/>\nFebruary 17,  1991 and,\t therefore, in relation to the State<br \/>\nof U.P.\t it is now settled law that when the State exercises<br \/>\nthe power  of eminent  domain and  in exercise\tof the power<br \/>\nunder  <a href=\"\/doc\/1908442\/\" id=\"a_1\">Section\t17(4)<\/a>  dispensing  with\t the  enquiry  under<br \/>\n<a href=\"\/doc\/1210757\/\" id=\"a_2\">Section 5-A<\/a> to acquire the land under <a href=\"\/doc\/1782611\/\" id=\"a_3\">Section 4(1)<\/a> the State<br \/>\nis entitled  to have the notification under <a href=\"\/doc\/1587307\/\" id=\"a_4\">Section 4(1)<\/a> and<br \/>\nthe declaration\t under <a href=\"\/doc\/582772\/\" id=\"a_5\">Section 6<\/a> simultaneously published so<br \/>\nas to  take further steps as required under <a href=\"\/doc\/1980619\/\" id=\"a_6\">Section 9<\/a> of the<br \/>\nAct, i.e.,  issuance of\t the notice  and  taking  possession<br \/>\nthereof under  <a href=\"\/doc\/1908442\/\" id=\"a_7\">Section 17(2)<\/a>  of the  Act.   Thereafter, the<br \/>\nland stands  vested in the State free from all encumbrances.<br \/>\nIn view\t of the\t urgency, the  Government exercised power of<br \/>\neminent domain\tand dispensed with the enquiry under <a href=\"\/doc\/1210757\/\" id=\"a_8\">Section<br \/>\n5-A<\/a>; we\t do not\t find any  illegality in the action taken by<br \/>\nthe respondents\t in having  the notification  under  <a href=\"\/doc\/1587307\/\" id=\"a_9\">Section<br \/>\n4(1)<\/a> and  the declaration  under  <a href=\"\/doc\/582772\/\" id=\"a_10\">Section  6<\/a>  simultaneously<br \/>\npublished.   It is  then sought\t to be\tcontended  that\t the<br \/>\nappellant has  a small\textent of  the land  and other lands<br \/>\nhave been  excluded from  acquisition and,  therefore, it is<br \/>\narbitrary exercise  of power.\tHe also seeks to contend the<br \/>\nprocedural  infirmities,   but\tunfortunately  none  of\t the<br \/>\ncontentions have  been pressed before the High Court, though<br \/>\nmight have  been raised\t in  writ  petition.\tUnder  those<br \/>\ncircumstances, we  cannot permit  the  appellants  to  argue<br \/>\nthese points afresh which are purely questions of fact to be<br \/>\nverified on  the basis\tof the\tmaterial as the State had no<br \/>\nopportunity to deal with them.\n<\/p>\n<p id=\"p_1\">     The appeals  are  accordingly  dismissed  but,  in\t the<br \/>\ncircumstances, without\tcosts.\tThe Land Acquisition Officer<br \/>\nis directed to pass the awards within a period of six months<br \/>\nfrom the date of the receipt of the order of this Court.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Supreme Court of India Mohd.
