SHAH\n\t\t\n\t\n\n \n\nDate\n: 09\/12\/2010 \n\n \n\nORAL\nORDER<\/pre>\n<p id=\"p_1\">1.\tThe<br \/>\npresent application has been preferred by the applicants-original<br \/>\naccused of Criminal Case No. 2143\/2009 to quash and set aside the<br \/>\nsaid Complaint, which has been filed by respondent no. 2 against the<br \/>\napplicants for the offence punishable under <a href=\"\/doc\/1823824\/\" id=\"a_1\">Section 138<\/a> of the<br \/>\nNegotiable Instruments Act.\n<\/p>\n<p id=\"p_1\">2.\tAfter<br \/>\nmaking some submission, Shri Barot, learned advocate appearing on<br \/>\nbehalf of the applicants does not press the present application qua<br \/>\nthe prayer to quash and set aside the impugned Criminal<br \/>\nCase\/Complaint, however, has requested to consider the case of<br \/>\napplicant no. 3-original accused no. 3 for permanent exemption from<br \/>\nappearing before the learned Magistrate on each and every date of<br \/>\nhearing of the  aforesaid Complaint.  However, he has submitted that<br \/>\nshe will remain present as and when required by the learned<br \/>\nMagistrate for the purpose of recording of the plea etc. and she will<br \/>\nbe appearing through the advocate.\n<\/p>\n<p id=\"p_2\">3.\tShri<br \/>\nL..R. Pathan, learned advocate appearing on behalf of respondent no.<br \/>\n2-original complainant has no objection if suitable observation is<br \/>\nmade that as and when required for the proceedings of the aforesaid<br \/>\nCriminal Complaint, inclusive of recording of the plea, applicant no.<br \/>\n3-original accused no. 3 shall remain present and she shall be<br \/>\nrepresented through a lawyer in the criminal case,  and,therefore, he<br \/>\nhas no objection if applicant no. 3-original accused no. 3, being a<br \/>\nlady, is granted permanent exemption.\n<\/p>\n<p id=\"p_3\">4.\tIn view<br \/>\nof the above, the present application is dismissed as not pressed.<br \/>\nSo far as the prayer of the applicants to quash and set aside the<br \/>\nimpugned Complaint, being Criminal Case No. 2143\/2009 pending in the<br \/>\nCourt of learned Metropolitan Magistrate, Court No. 7, Ahmedabad is<br \/>\nconcerned, considering the request made by Shri Barot, learned<br \/>\nadvocate appearing on behalf of the applicants, applicant no.<br \/>\n3-original accused no. 3 is granted permanent exemption to appear<br \/>\nbefore the concerned learned Magistrate on each and every date of<br \/>\nhearing of the Criminal Case on condition that applicant no. 3 shall<br \/>\nappear before the learned Magistrate through the advocate and shall<br \/>\nappear before the Court as and when required by the learned<br \/>\nMagistrate for the purpose of hearing of the aforesaid Criminal Case<br \/>\ni.e. for the purpose of recording of the plea etc. she shall make<br \/>\nherself available and  on that ground there shall not be any delay in<br \/>\nproceeding further with the criminal case.\n<\/p>\n<p id=\"p_4\">5.\tWith<br \/>\nthis, the present application is disposed of with the above<br \/>\ndirection.\n<\/p>\n<p id=\"p_5\">\tDirect<br \/>\nservice is permitted.\n<\/p>\n<p id=\"p_6\">\t\t\t\t\t\t\t(M.R.\n<\/p>\n<p id=\"p_7\">SHAH, J.)<\/p>\n<p>siji<\/p>\n<p>\t\t   \u00a0\u00a0\u00a0<\/p>\n<p>\t\t   Top<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Gujarat High Court Shraddha vs State on 9 December, 2010 Author: M.R.
