SHAH\n\t\t\n\t\n\n \n\nDate\n: 24\/01\/2011 \n\n \n\n \nORAL\nORDER<\/pre>\n<p id=\"p_1\">1.\t\tAll<br \/>\nthese applications under <a href=\"\/doc\/100581\/\" id=\"a_1\">Section 5<\/a> of the Limitation Act, have been<br \/>\npreferred by the applicants &#8211; original appellants &#8211;<br \/>\noriginal Opponents to condone the delay of 786 days in preferring<br \/>\nFirst Appeals challenging the common judgement and award dated<br \/>\n26\/03\/2008 passed by learned 9th Additional Senior Civil<br \/>\nJudge, Mahesana in Land Reference Case Nos.4499\/2003  to 4506 of<br \/>\n2003.\n<\/p>\n<p id=\"p_1\">2.\t\tThough<br \/>\nserved, nobody appears on behalf of the respondent &#8211; original<br \/>\nclaimant. Hence, it appears that there is no opposition to the<br \/>\npresent applications.\n<\/p>\n<p id=\"p_2\">3.\t\tEven<br \/>\notherwise, considering the averments in the applications in support<br \/>\nof the prayer to condone delay in preferring the First Appeals, this<br \/>\nCourt is prima facie satisfied that sufficient cause has been made<br \/>\nout and  even otherwise so as to give an additional opportunity to<br \/>\nthe applicants to submit their case on merits rather than<br \/>\nnon-shutting the same on technical ground of delay, delay caused in<br \/>\npreferring the respective First Appeals are hereby condoned. Rule is<br \/>\nmade absolute to the aforesaid extent in each of the applications.
