Heard learned counsel for the parties.\n<\/p>\n<p id=\"p_2\">2.   The petitioner on the basis of alleged irregularities<br \/>\npurported to have been committed by the Secretary of the<br \/>\nrespondent No.6 association, seeks a direction to the<br \/>\nrespondent No.2 &amp; 3 to exercise the powers under Section<br \/>\n33 of the Chhattisgarh Society Registrikaran Adhiniyam,<br \/>\n1973 (for short &#8220;the Adhiniyam, 1973&#8221;) and supersede the<br \/>\nrespondent No.6 and to take the management of respondent<br \/>\nNo.6 in its hands. Further, a writ of mandamus to the<br \/>\nrespondent No.2 &amp; 3 to stop respondent No.7 from working<br \/>\nas Secretary to the respondent No.6 association.\n<\/p>\n<p id=\"p_3\">3.   Be that as it may, on a special query whether any<br \/>\napplication has been made either to the State Government<br \/>\nor to the Registrar, learned counsel appearing for the<br \/>\npetitioner submits that a representation has been made to<br \/>\nthe Deputy Registrar, Societies and Firms, Bilaspur<br \/>\nDivision, Bilaspur, on 29\/07\/2010 (Annexure D) seeking an<br \/>\naction against one      Shri N.A. Khan to stop his illegal<br \/>\nactivities and to remove him for  violation of law as well<br \/>\nas the resolution dated 26\/03\/2009.\n<\/p>\n<p id=\"p_4\">4.   The petitioner is seeking a direction to comply with<br \/>\nthe statutory provisions contained under the provisions of<br \/>\nSection 33 of the Adhiniyam, 1973.  Section 33 of the<br \/>\nAdhiniyam, 1973 begins with the words &#8220;If, in the opinion<br \/>\nof the State Government&#8221;.  Thus, the State Government has<br \/>\nto form its opinion on the basis of certain documents or<br \/>\napplication made by the competent people to make the<br \/>\napplication.\n<\/p>\n<p id=\"p_5\">5.   It is a case where the petitioner has not attempted<br \/>\nto approach the State Government or the Registrar for<br \/>\nexercise of its power under the provision of Section 33 of<br \/>\nthe Adhiniyam, 1973 had rather chosen to approach this<br \/>\nCourt directly under <a href=\"\/doc\/1712542\/\" id=\"a_1\">Article 226<\/a> of the Constitution of<br \/>\nIndia seeking a direction against the State respondent to<br \/>\nact under the provisions of Section 33 of the Adhiniyam,<br \/>\n1973.\n<\/p>\n<p id=\"p_6\">6.   This is a very unusual case, where it appears that<br \/>\nthe petitioner has by-passed all the statutory provisions<br \/>\nand seeking a direction, which may not be granted when<br \/>\nthere is no application to the Registrar of Societies or<br \/>\nthe State Government, as the case may be, and, as such,<br \/>\nthe State Government has no opportunity to form its<br \/>\nopinion to take action under the provisions of Section 33<br \/>\nof the Adhiniyam, 1973 against the respondent No. 6 &amp; 7.\n<\/p>\n<p id=\"p_7\">7.   It is a trite law that a petitioner seeking writ of<br \/>\nmandamus must have a judicially enforceable legal right,<br \/>\nwhich has been infringed.\n<\/p>\n<p id=\"p_8\">8.   The Supreme Court in <a href=\"\/doc\/176845\/\" id=\"a_2\">Mani Subrat Jain and others vs.<br \/>\nState of Haryana<\/a> and others1, held as under :-\n<\/p>\n<blockquote id=\"blockquote_1\"><p>           &#8220;9.   The   High Court  rightly<br \/>\n           dismissed  the  petitions.   It<br \/>\n           is  elementary though it is  to<br \/>\n           be  restated that  no  one  can<br \/>\n           ask  for  a mandamus without  a<br \/>\n           legal right.  There must  be  a<br \/>\n           judicially enforceable right as<br \/>\n           well  as  a  legally  protected<br \/>\n           right   before one suffering  a<br \/>\n           legal grievance can ask for   a<br \/>\n           mandamus.  A person can be said<br \/>\n           to  be  aggrieved only when   a<br \/>\n           person is denied a legal  right<br \/>\n           by  some  one who has a   legal<br \/>\n           duty to  do    something or  to<br \/>\n           abstain  from  doing  something<br \/>\n           (See   Halsbury&#8217;s    Laws    of<br \/>\n           England,   4th  Ed.   Vol.   I,<br \/>\n           paragraph 122; <a href=\"\/doc\/470118\/\" id=\"a_3\">State of Haryana<br \/>\n           v.  Subash  Chander  Marwaha  &amp;<br \/>\n           Ors.  Jasbhai   Motibhai  Desai<\/a><br \/>\n           v.  Roshan  Kumar  Haji  Bashir<br \/>\n           Ahmed   &amp;   Ors.   and   Ferris<br \/>\n           Extraordinary  Legal   Remedies<br \/>\n           paragraph 198.&#8221;\n<\/p><\/blockquote>\n<p id=\"p_9\">  9.   <a href=\"\/doc\/1906492\/\" id=\"a_4\">In Dr. Umakant Saran vs. State of Bihar<\/a> and others2,<br \/>\n       the Supreme Court observed as under :-\n<\/p>\n<blockquote id=\"blockquote_1\"><p>           &#8220;10. This Court has pointed out<br \/>\n           in <a href=\"\/doc\/1734503\/\" id=\"a_5\">Dr. Rai Shivendra Bahadur v.<br \/>\n           The   Governing  Body  of   the<br \/>\n           Nalanda College<\/a>, that in  order<br \/>\n           that  mandamus  may  issue   to<br \/>\n           compel  the authorities  to  do<br \/>\n           something,  it  must  be  shown<br \/>\n           that  the  statute  imposes   a<br \/>\n           legal  duty  and the  aggrieved<br \/>\n           party  have a legal right under<br \/>\n           the   statute  to  enforce  its<br \/>\n           performance. xxx    xxx    xxx&#8221;\n<\/p><\/blockquote>\n<p id=\"p_10\">  10.  The petitioner has not established any legally<br \/>\n       enforceable right to seek the aforestated writ of mandamus<br \/>\n       or any other writ.\n<\/p>\n<p id=\"p_11\">11.  The letter dated 29\/07\/2010 addressed to the Deputy<br \/>\nRegistrar, Societies and Firms, Bilaspur Division,<br \/>\nBilaspur, does not seek exercise of powers under the<br \/>\nprovisions of Section 33 of the Adhiniyam, 1973 and, as<br \/>\nsuch, it cannot be said that the petitioner has made an<br \/>\napplication to the Registrar or the State Government, as<br \/>\nthe case may be.\n<\/p>\n<p id=\"p_12\">12.  Thus, this petition is frivolous, without any basis<br \/>\nand is accordingly dismissed.
