the selections made ai*es_eor}=tlra1*y\u00a7_: prilneiplle.\n<\/p>\n
4. The Tribunal on co-nlsideravtionl”ofriyal contentions<\/p>\n
held   ‘applicant. falls under the<\/p>\n
category “rare hand” eicceptional circumstances. The<\/p>\n
 overall’ “asseslsr11en_t___of very good given to Abdul Bari<\/p>\n
‘Nlawai:x,’petitivo_ner herein, and grading of only good to<\/p>\n
 respondent herein, does not reflect the<\/p>\n
 true .afid fair assessment of the merits of these two<\/p>\n
9’  officials and the applicant was entitled to fair treatment<\/p>\n
in the matter of Consideration for promotion. In their<\/p>\n
.-,,…_AdVmi’tteC11y; .._1’10 c;Lse’0or bias or malafide is pleaded or<\/p>\n
 that ground, the selection is not<\/p>\n
 t;he=gi*0und of some procedural irreguiarities. In this
\n  ‘ifeg–;_.r’d. the law is well settled that the T ribtmal could<\/p>\n
 -~-F1V()t. interfere with the seIeCti()11. Therefore. the<\/p>\n

\nassessment, the selection made by the selection<\/p>\n
committee for the panel year 1998 has not been done in<\/p>\n
a fair and equitable manner. Therefore, the Tribunal
\ndeclined to consider the selection for the sutiserjnueiqyt,
\nyear 1999 and 2000 and eonsequentiai
\nmade. Therefore. the ‘1’ribuna}.-J’rQ.;1Jai”1ded;.”

\npetitioners submit that the inipugned order requires to<\/p>\n
be set aside.\n<\/p>\n
5. The law on the point is very well settled. T he-‘-Apex<\/p>\n
Court. in the case of Badrinath -vs– Goverr1″rnen:”tri.of<\/p>\n
Tamil Nadu reported in 2000 SC 3243 dealing   <\/p>\n
scope of judicial review of selection  <\/p>\n

\n. “‘vi’cont’:he}=decision ~\u00bb~ then the powers of judicial
\nreview under Article 226<\/a> of the Constitution
\narelnot foreclosed.\n<\/p>\n
 .541. While the Courts are to be extremely
\ncareful in exercising the power of judicial
\nreview in dealing with assessment made by<\/p>\n

\nDepartme11t.al Promotion Comrnittees, t.he
\nexecutive is also to bear in mind that, in
\nexceptional cases, the assessment of merit
\nmade by them is liable to be scrutinized by
\nCourts, within the narrow Wednesbury,_
\nprinciples or on the ground of mala fidesfz

mref cases where interference is called for by the<\/p>\n

  and the entries for the particular year in<\/p>\n
compliance with the Rules made therein. All that it can<\/p>\n

\ngood, he has been graded as good and
\nfauit with. It cannot be a ground as iaid
\nApex Court in its aforesaid judvgfAne11t&_
