BHATT\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 22\/02\/2011 \n\n \n\n \nORAL\nORDER<\/pre>\n<p id=\"p_1\">(Per<br \/>\n: HONOURABLE MR.JUSTICE RAVI R.TRIPATHI)<\/p>\n<p>1.0\tPresent<br \/>\napplication is filed by the applicant &#8211; convict through jail<br \/>\nrequesting to regularize the late surrender of the the convict after<br \/>\nhe was released on Temporary Bail by the order of this Court.  He was<br \/>\nreleased on Temporary Bail for 14 days from<br \/>\n1st January<br \/>\n2011.  He surrendered late by 15 days, on<br \/>\n29th January<br \/>\n2011.\n<\/p>\n<p id=\"p_1\">2.0\tLearned<br \/>\nAdditional Public Prosecutor Mr. Raval invited the attention of the<br \/>\nCourt to reason set out by the convict in the application.  The<br \/>\nconvict has set out that while he was working in the &#8216;Press<br \/>\nDepartment&#8217; of the jail on a &#8216;Paper Cutting Machine&#8217;, he sustained<br \/>\ninjury on his right hand thumb.  He was given treatment in SSG<br \/>\nHospital for the same.  He was also operated in the hospital, but, as<br \/>\nhe required further treatment, he prayed for 15 days&#8217; Temporary Bail<br \/>\nbefore the Court and the Court granted the same.  It is further<br \/>\nstated in the application further that, while he was taking<br \/>\ntreatment, his thumb was again operated and there was a &#8216;skin<br \/>\ngrafting&#8217; from finger to the thumb and he was not able to perform his<br \/>\ndaily routine and therefore, he could not surrender to the jail<br \/>\nauthorities in time and surrendered late by 15 days, of his own.  The<br \/>\nonly lapse on the part of the applicant is that, he did not intimate<br \/>\nto the jail authorities and he did not come to this Court for<br \/>\nextension of Temporary Bail at the relevant time.\n<\/p>\n<p id=\"p_2\">3.0\tRule.\n<\/p>\n<p id=\"p_3\"> Learned Additional Public Prosecutor Mr. Raval waives service of<br \/>\nprocess of Rule.\n<\/p>\n<p id=\"p_4\">4.0\tTaking<br \/>\ninto consideration the aforesaid contents and taking a liberal<br \/>\napproach in the matter, the application is allowed.  Late surrender<br \/>\nof 15 days is hereby regularized by ordering retrospective Temporary<br \/>\nBail for that period.\n<\/p>\n<p id=\"p_5\">4.1\tRule<br \/>\nis made absolute.\n<\/p>\n<p id=\"p_6\">[<br \/>\nRavi R.
