Justice P.R.RAMACHANDRA MENON\n\n Dated :12\/01\/2010\n\n O R D E R\n                    P.R.RAMACHANDRA MENON, J\n                  -----------------------------\n                        W.P(C) No.24510 of 2009 -G\n                  ------------------------------\n              Dated this the 12th day of January, 2010.\n\n                          J U D G M E N T\n<\/pre>\n<p id=\"p_1\">      The petitioner has approached this Court        seeking for the<\/p>\n<p>following reliefs:\n<\/p>\n<blockquote id=\"blockquote_1\"><p>            &#8220;i) Issue a writ of mandamus or any other writ or<\/p>\n<p>            direction directing respondents 1 and 2 to recover<\/p>\n<p>            the defaulted dewatering charges (nerma amount)<\/p>\n<p>            legally due to the petitioner for Mathamkari<\/p>\n<p>            Padasekharam, Muttuchira, for the 1176, 1177,<\/p>\n<p>            1178, 1179, 1180, 1181, 1182 ME from the<\/p>\n<p>            defaulting proprietors\/cultivators of the above<\/p>\n<p>            padasekharam under the <a href=\"\/doc\/201374\/\" id=\"a_1\">Revenue        Recovery Act<\/a><\/p>\n<p>            immediately within a time frame to be fixed by this<\/p>\n<p>            Hon&#8217;ble Court and to disburse the same to the<\/p>\n<p>            petitioner immediately.\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_1\"><p>            ii) Grant such other reliefs, as this Hon&#8217;ble Court<\/p>\n<p>            may deem just and proper in the interest of justice,<\/p>\n<p>            including costs. &#8220;<\/p><\/blockquote>\n<p id=\"p_1\">\n<p id=\"p_2\">      2.   Considering the nature of the reliefs sought for, it was<\/p>\n<p>necessary to hear the 3rd and 4th respondents besides the learned<\/p>\n<p>Government      Pleader,  who   entered  appearance    on   behalf of<\/p>\n<p>respondents 1 and 2. In the said circumstances, though notice was<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">W.P(C) No.24510 of 2009 -G           2<\/span><\/p>\n<p>ordered to respondents 3 and 4 and the same has been duly served,<\/p>\n<p>there is no representation from their side, which means that the said<\/p>\n<p>respondents have absolutely no objection whatsoever in granting the<\/p>\n<p>reliefs prayed for.\n<\/p>\n<p id=\"p_3\">       In the above facts and circumstances, the second respondent is<\/p>\n<p>directed to consider the matter and to take appropriate steps          to<\/p>\n<p>recover the defaulted amounts legally due to the petitioner in respect<\/p>\n<p>of the cultivation in question from the defaulting proprietors\/cultivators<\/p>\n<p>of the concerned padasekharam, invoking the relevant provisions<\/p>\n<p>under the <a href=\"\/doc\/201374\/\" id=\"a_1\">Revenue Recovery Act<\/a>, of course, in accordance with law.<\/p>\n<p>Necessary steps shall be pursued as above, as expeditiously as<\/p>\n<p>possible and at any rate within a period of 4 months from the date of<\/p>\n<p>receipt of a copy of the judgment.\n<\/p>\n<p id=\"p_4\">       The Writ Petition is disposed of as above.<\/p>\n<p id=\"p_5\">                                                  Sd\/-\n<\/p>\n<p id=\"p_6\">                                     P.R.
