PUBLIC PROSECUTOR for\nApplicant(s) : 1, \nRULE SERVED for Respondent(s) : 1 - 2. \nMR\nVIKESH GAJJAR FOR M\/S S G ASSOCIATES for Respondent(s) : 1 -\n2. \n=========================================\n \n\t  \n\t \n\t  \n\t\t \n\t\t\t \n\nCORAM\n\t\t\t: \n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE Z.K.SAIYED\n\t\t\n\t\n\n \n\nDate\n: 20\/01\/2011\n \n\nORAL\nORDER<\/pre>\n<p id=\"p_1\">By<br \/>\n\tway of present application, the applicant-State has prayed to cancel<br \/>\n\tthe order dated 21st<br \/>\n\tSeptember 2010 granting regular bail passed by the learned Presiding<br \/>\n\tOfficer, 6th<br \/>\n\tFast Track Court, Gondal in Criminal Miscellaneous Application<br \/>\n\tNo.357 of 2010 to the respondent-accused.\n<\/p>\n<p id=\"p_1\">Heard<br \/>\n\tMr.H.L. Jani, learned Additional Public Prosecutor appearing for the<br \/>\n\tapplicant-State and Mr.Vikesh Gajjar for S.G. Associates.\n<\/p>\n<p id=\"p_2\">Mr.\n<\/p>\n<p id=\"p_3\">\tJani has read the contention of the First Information Report and<br \/>\n\tvehemently argued that this is a serious case and even prima-facie<br \/>\n\tthe case was established beyond reasonable doubt against the<br \/>\n\trespondent-accused before the learned Judge. He has also contended<br \/>\n\tthat the role of the respondent-accused is also established beyond<br \/>\n\treasonable doubt. Mr.Jani has also read the order passed by the<br \/>\n\tlearned Judge and contended that without considering the documentary<br \/>\n\tevidence<br \/>\n\tproduced before him, the learned Judge has passed the impugned<br \/>\n\torder. He, therefore, contended that the order passed by the learned<br \/>\n\tJudge is required to be cancelled and the respondent-accused may be<br \/>\n\tdirected to surrender himself.\n<\/p>\n<p id=\"p_4\">\tMr.Gajjar<br \/>\n\thas contended that presence of the present respondent is not<br \/>\n\testablished beyond reasonable doubt. He has also read the order<br \/>\n\tpassed by the learned Judge and argued that the role of the present<br \/>\n\trespondent is not established. He has also contended that after<br \/>\n\tconsidering all the evidence produced before him, the learned Judge<br \/>\n\thas passed the order. There is no reason for the applicant to say<br \/>\n\tthat the order passed by the learned Judge is not as per the<br \/>\n\tprovisions of the law. He, therefore, contended that the present<br \/>\n\tapplication is required to be rejected.\n<\/p>\n<p id=\"p_5\">I<br \/>\n\thave gone through the papers produced before me as well as<br \/>\n\tsubmissions advanced by the learned counsel for the parties. I have<br \/>\n\talso perused the order passed by the learned Judge.\n<\/p>\n<p id=\"p_6\">Without<br \/>\n\tentering into the merits of the case, I am of the opinion that there<br \/>\n\tis nothing in the application to cancel the bail granted to the<br \/>\n\trespondent-accused. I have not found any substance in the present<br \/>\n\tapplication. Hence, the present application deserves to be dismissed<br \/>\n\tand is hereby dismissed.
