Justice R.BASANT\n\n Dated :19\/12\/2007\n\n O R D E R\n                              R.BASANT, J\n                      ------------------------------------\n                     Crl.M.C.No.3788 of 2007\n                      -------------------------------------\n             Dated this the 19th day of December, 2007\n\n                                O R D E R\n<\/pre>\n<p id=\"p_1\">      Petitioners face indictment in a prosecution for offences<\/p>\n<p>punishable, inter alia, under <a href=\"\/doc\/839778\/\" id=\"a_1\">Sections 380<\/a> and <a href=\"\/doc\/513777\/\" id=\"a_1\">451<\/a> I.P.C.<\/p>\n<p>Cognizance has been taken as early as in 2000 as can be seen<\/p>\n<p>from the number assigned to the case &#8211; C.C.No.232 of 2000. The<\/p>\n<p>petitioners had appeared before the learned Magistrate. They<\/p>\n<p>were enlarged on bail.         But subsequently they have started<\/p>\n<p>absconding and coercive processes have been issued against the<\/p>\n<p>petitioners by the learned Magistrate. The petitioners find such<\/p>\n<p>processes chasing them.\n<\/p>\n<p id=\"p_1\">      2.    According to the petitioners, they are absolutely<\/p>\n<p>innocent. Their absence earlier was not wilful or deliberate. They<\/p>\n<p>are willing to surrender before the learned Magistrate and apply<\/p>\n<p>for bail. But they apprehend that their application for regular bail<\/p>\n<p>may not be considered by the learned Magistrate on merits, in<\/p>\n<p>accordance with law and expeditiously. It is therefore prayed that<\/p>\n<p>directions under <a href=\"\/doc\/1679850\/\" id=\"a_2\">Section 482<\/a> Cr.P.C may be issued in favour of the<\/p>\n<p>petitioners.\n<\/p>\n<p id=\"p_2\"><span class=\"hidden_text\" id=\"span_1\">Crl.M.C.No.3788 of 2007          2<\/span><\/p>\n<p id=\"p_3\">     3.    It is for the petitioners to appear before the learned<\/p>\n<p>Magistrate   and    explain    to  the   learned   Magistrate   the<\/p>\n<p>circumstances under which they could not earlier appear before<\/p>\n<p>the learned Magistrate.    I have no reason to assume that the<\/p>\n<p>learned Magistrate would not consider such application on merits,<\/p>\n<p>in accordance with law and expeditiously. Every court must do<\/p>\n<p>the same.      No special or specific direction appears to be<\/p>\n<p>necessary. Sufficient general directions have already been issued<\/p>\n<p>in Alice George v. The Deputy Superintendent of Police<\/p>\n<p>[2003(1) KLT 339].\n<\/p>\n<p id=\"p_4\">     4.
