The applicant has<br \/>\n\tfurther prayed for the direction to make an adhoc disbursement of an<br \/>\n\tamount as deemed fit by this Court.\n<\/p>\n<p id=\"p_1\">An<br \/>\n\taffidavit in support of the Judge&#8217;s Summons is filed by the Chief<br \/>\n\tManager, Asset Recovery Management Branch of the applicant Bank.<br \/>\n\tMr. Bharat Jani, learned advocate appearing for the applicant has<br \/>\n\tsubmitted that the Company went into liquidation on 14.09.2000.  The<br \/>\n\tOfficial Liquidator has thereafter filed Official Liquidator Report<br \/>\n\tNo.41 of 2004, inter alia,<br \/>\n\tpraying for confirmation of sale of plant and machinery, building<br \/>\n\tstructure and shed other than land, time keeper&#8217;s office etc.  The<br \/>\n\tsame was confirmed in favour of M\/s. Noble Trading Company for<br \/>\n\tRs.4.51 Lacs in respect of the plant and machinery, building<br \/>\n\tstructure and shed.  Thereafter, sale of land was also confirmed for<br \/>\n\tRs. 30 Lacs.\n<\/p>\n<p id=\"p_2\">Mr.\n<\/p>\n<p id=\"p_3\">\tJani further submitted that the claims were invited by the Official<br \/>\n\tLiquidator.  However, except the applicant Bank, neither Secured<br \/>\n\tCreditor nor any worker has lodged its claim.  The claim of the<br \/>\n\tapplicant Bank was referred to the Chartered Accountant and the<br \/>\n\tChartered Accountant has submitted his report on 25.05.2010.  He<br \/>\n\thas, therefore, submitted that since the applicant Bank is the only<br \/>\n\tSecured Creditor, the amount realized by the Official<br \/>\n\tLiquidator from sale of the assets of the Company in liquidation,<br \/>\n\tafter deducting the expenses, the balance amount should be disbursed<br \/>\n\tin favour of the applicant Bank.\n<\/p>\n<p id=\"p_4\">The<br \/>\n\tOfficial Liquidator has filed his report on 22.02.2010 along with<br \/>\n\tthe report of the Chartered Accountant.  Further report was filed by<br \/>\n\tthe Official Liquidator on 26.06.2010.  The Chartered Accountant in<br \/>\n\this report has observed that on verification of the records made<br \/>\n\tavailable to him, the Bank of Baroda has provided an affidavit of<br \/>\n\tproof of debt claiming total dues of Rs.1,82,60,353\/- upto the date<br \/>\n\tof 14.06.2008 which includes the claim of Rs.1,26,62,436\/- upto the<br \/>\n\tdate of winding up i.e. 14.09.2000.  This claim also includes<br \/>\n\tinterest of Rs.10,18,817\/- for the period from 30.03.1999 to<br \/>\n\t14.09.2000 @ 6% as recommended by DRT.  On the basis of these facts<br \/>\n\tand records, the Chartered Accountant has given his opinion that<br \/>\n\tBank of Baroda is the only Secured charge holder of the Company in<br \/>\n\tliquidation and eligible for the claim of Rs.1,26,62,436\/- upto the<br \/>\n\tdate 14.09.2000 i.e. the date of winding up.  The Official<br \/>\n\tLiquidator has further stated that he is having the fund for an<br \/>\n\tamount of Rs.32,95,303\/- in the Company&#8217;s account.  He has sought<br \/>\n\tthe permission to keep an amount of Rs.2,95,303\/- to meet with<br \/>\n\tfuture expenses and Rs.30 Lacs can be disbursed in favour of the<br \/>\n\tapplicant Bank.  In his further report dated 26.06.2010, he has<br \/>\n\tgiven the statement of receipt and payment and thereafter sought the<br \/>\n\tpermission to retain the amount of Rs.2,95,303\/- and to make the<br \/>\n\tpayment of Rs.27,575\/- to the Chartered Accountant against his<br \/>\n\tprofessional bill dated 13.07.2010.\n<\/p>\n<p id=\"p_5\">Having<br \/>\n\theard learned advocates appearing for the parties and having<br \/>\n\tconsidered the documents produced on record as well as the report<br \/>\n\tfiled by the Chartered Accountant as well as the Official<br \/>\n\tLiquidator, the Court is of the view that the applicant Bank being<br \/>\n\tthe only Secured Creditor, the amount realized on the sale of the<br \/>\n\tassets of the Company in liquidation is required to be disbursed in<br \/>\n\tfavour of the applicant Bank.  Since the amount of Rs.32,95,303\/- is<br \/>\n\tavailable on the Company&#8217;s account for disbursement after taking<br \/>\n\tinto consideration all expenses incurred by the Official Liquidator,<br \/>\n\tthe Official Liquidator is directed to disburse an amount of Rs.32<br \/>\n\tLacs in favour of the applicant Bank after obtaining an usual<br \/>\n\tundertaking from the Bank stating therein specifically that in case,<br \/>\n\tany claim arises against the Company in liquidation either by any<br \/>\n\tSecured Creditor or Worker or any Statutory Creditor and the same is<br \/>\n\trequired to be satisfied, the applicant Bank shall be liable to<br \/>\n\treturn the amount to this extent with prevalent rate of interest to<br \/>\n\tthe Official Liquidator.  The Official Liquidator is further<br \/>\n\tpermitted to make the payment to the Chartered Accountant towards<br \/>\n\this professional bill as per the Scheme sanctioned by this Court.\n<\/p>\n<p id=\"p_6\">With<br \/>\n\tthis direction and observation, this application is accordingly<br \/>\n\tdisposed of.\n<\/p>\n<p id=\"p_7\">\t\t\t\t\t\t\t\t\tSd\/-\n<\/p>\n<p id=\"p_8\">\t\t\t\t\t\t\t\t[K.
