JUSTICE ABHILASHA KUMARI\n\t\t\n\t\n\n \n\nDate\n: 28\/09\/2011 \n\n \n\n \nORAL\nORDER<\/pre>\n<p id=\"p_1\">\tThis<br \/>\napplication has been filed by the applicant-original petitioner, with<br \/>\nthe following prayers:-\n<\/p>\n<p id=\"p_1\">&#8220;(A)\tYour<br \/>\nLordships may be pleased to admit this application.\n<\/p>\n<p id=\"p_2\">(B)\tThat<br \/>\nthe name of department of respondent No.1 in Special Civil<br \/>\nApplication No.14777\/10 may be permitted to correct as the Secretary,<br \/>\nPanchayats, Urban Development and Urban Housing Department, Block<br \/>\nNo.14, Sachivalaya Gandhinagar.\n<\/p>\n<p id=\"p_3\">(C)\tThat<br \/>\nthe name of respondent no.1 &#8220;Rural Housing and Rural<br \/>\nDevelopment Department&#8221; may be permitted to delete.\n<\/p>\n<p id=\"p_4\">(D)\tThat<br \/>\nthe order dated 26-11-2010 passed in Special Civil Application<br \/>\nNo.14777 of 2010 may passed a fresh, and necessary direction may be<br \/>\npassed to consider fresh representation by the Secretary, Urban<br \/>\nDevelopment as possible as early.\n<\/p>\n<p id=\"p_5\">(E)\tAny<br \/>\nother appropriate order deem fit may be passed in the interest of<br \/>\njustice in favour of the petitioner.&#8221;\n<\/p>\n<p id=\"p_6\">\tThe<br \/>\npetitioner had preferred a petition, being Special Civil Application<br \/>\nNo.14777 of 2010, which was disposed of by order dated 26.11.2010 of<br \/>\nthis Court, by permitting the petitioner to make a representation to<br \/>\nrespondent No.1, with a direction to decide the same, within a period<br \/>\nof three months from the receipt thereof.\n<\/p>\n<p id=\"p_7\">\tThe<br \/>\npetitioner made a representation before the Secretary, Panchayats,<br \/>\nRural Housing and Rural Development, who was impleaded, as respondent<br \/>\nNo.1 in the said petition. The petitioner has now been informed by<br \/>\nrespondent No.1 that the subject matter of the representation is not<br \/>\nrelated to him, that is, the Secretary, Rural Housing and Rural<br \/>\nDevelopment, therefore, he may approach the Court, in order to<br \/>\ncorrect the designation of respondent No.1 and change it to &#8220;The<br \/>\nSecretary, Panchayats, Urban Development and Urban Housing<br \/>\nDepartment. Accordingly, the petitioner has preferred the present<br \/>\napplication.\n<\/p>\n<p id=\"p_8\">\tI<br \/>\nhave heard Mr.M.A. Bukhari, learned advocate for the applicant and<br \/>\nMr.A.J. Desai, learned Assistant Government Pleader for respondent<br \/>\nNo.1-State of Gujarat and perused the averments made in the<br \/>\napplication.\n<\/p>\n<p id=\"p_9\">\tAs<br \/>\nit appears that the Secretary, Rural Housing and Rural Development is<br \/>\nnot concerned with the subject matter of the representation, as has<br \/>\nbeen stated by respondent No.1, the prayers made by the petitioner<br \/>\ndeserve to be granted. Accordingly, the following order is passed:\n<\/p>\n<p id=\"p_10\">\tThe<br \/>\napplicant is permitted to correct the designation of respondent No.1<br \/>\nin Special Civil Application No.14777 of 2010, by mentioning &#8220;The<br \/>\nSecretary, Panchayats, Urban Development and Urban Housing<br \/>\nDepartment&#8221;, instead of &#8220;The Secretary, Panchayats, Rural<br \/>\nHousing and Rural Development&#8221;. The correction\/amendment in the<br \/>\ncause-title of the said petition be carried out, forthwith.\n<\/p>\n<p id=\"p_11\">\tIn<br \/>\nview of the above, the petitioner may now make a representation<br \/>\nbefore the Secretary, Panchayats, Urban Development and Urban Housing<br \/>\nDepartment, within a period of fifteen days from today.\n<\/p>\n<p id=\"p_12\">\tIn<br \/>\nthe event that the representation is made by the petitioner, the<br \/>\nSecretary, Urban Development and Urban Housing Department, shall<br \/>\nconsider and decide the same, in accordance with law, as<br \/>\nexpeditiously as possible and without avoidable delay.
