NO. 345 OF 2007 A\n               ---------------------------------------------------\n                   Dated this the 16th June, 2009\n\n                               JUDGMENT\n<\/pre>\n<p id=\"p_1\">Joseph, J.\n<\/p>\n<p id=\"p_1\">\n<p id=\"p_2\">      Appellant is the claimant in a petition filed under <a href=\"\/doc\/136948773\/\" id=\"a_1\">Section<\/p>\n<p>166<\/a> of the Motor Vehicles Act. He is dissatisfied with the<\/p>\n<p>quantum of compensation awarded.\n<\/p>\n<p id=\"p_3\">      2. We heard the learned counsel for the appellant as also<\/p>\n<p>the learned counsel appearing for the second respondent,<\/p>\n<p>Insurance Company.\n<\/p>\n<p id=\"p_4\">      3. The appellant is awarded a sum of Rs.78,826\/= with<\/p>\n<p>interest at 6 per cent. Learned counsel for the appellant submits<\/p>\n<p>that the income is erroneously taken as Rs.1,500\/= per month<\/p>\n<p>and the accident took place in the year 2000. Appellant was a<\/p>\n<p>milk vendor and it is submitted that he was maintaining a<\/p>\n<p>family.    He has given oral evidence also. Learned counsel<\/p>\n<p>further contends that in arriving at the disability, the tribunal<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">MACA.345\/07                   2<\/span><\/p>\n<p>should have taken permanent disability at 25 per cent. In this<\/p>\n<p>regard he relies of a Certificate issued by the Doctor. This<\/p>\n<p>Certificate was issued on 1.5.2001. The tribunal found that<\/p>\n<p>when the Doctor examined the appellant on 12.8.2005, he<\/p>\n<p>assessed only 12 per cent permanent disability.         It was<\/p>\n<p>thereupon,. after taking note of the injuries sustained and the<\/p>\n<p>period of treatment undergone and the functional disability<\/p>\n<p>caused to him that the tribunal arrived at the finding that the<\/p>\n<p>appellant suffered 12 per cent permanent disability.    It was<\/p>\n<p>accordingly that compensation for disability was arrived at<\/p>\n<p>Rs.17,280\/=. Counsel for the appellant further points out that<\/p>\n<p>the appellant has incurred expenses towards transport for<\/p>\n<p>availing treatment three times. Appellant was awarded only<\/p>\n<p>Rs.500\/=.   He submits that towards pain and suffering, the<\/p>\n<p>appellant was awarded only Rs.12,000\/=.<\/p>\n<p id=\"p_5\">     4. Learned counsel for the respondent Insurance Company<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">MACA.345\/07                      3<\/span><\/p>\n<p>would support the Award. Having heard the learned counsel for<\/p>\n<p>the parties, we feel that the appellant should be entitled to<\/p>\n<p>enhancement in compensation. We notice that the accident took<\/p>\n<p>place in the year 2000. Appellant was aged 58 years and he was<\/p>\n<p>maintaining a family, and having regard to the fact that he has<\/p>\n<p>also given evidence, we can safely take the income of the<\/p>\n<p>appellant at Rs.2,000\/= per month. If that be so, the appellant<\/p>\n<p>would be entitled to Rs.5,760\/= more towards disability which is<\/p>\n<p>rounded off to Rs.6,000\/=. We feel that the appellant should also<\/p>\n<p>be awarded Rs.1,000\/= more towards transportation. Further,<\/p>\n<p>having regard to the fact that the appellant was in hospital for 47<\/p>\n<p>days and had suffered three major fractures, for pain and<\/p>\n<p>suffering, the appellant should be awarded a sum of Rs.3,000\/=<\/p>\n<p>more.    Accordingly, the Appeal is allowed in part and the<\/p>\n<p>appellant is allowed to realise Rs.10,000\/= more with interest at<\/p>\n<p>7.5 per cent from the date of the petition till the date of<\/p>\n<p>realisation from the respondents.     There will be a direction<\/p>\n<p><span class=\"hidden_text\" id=\"span_2\">MACA.345\/07                    4<\/span><\/p>\n<p>against the second respondent to deposit the aforesaid amount<\/p>\n<p>within one month from today and the appellant is allowed to<\/p>\n<p>withdraw the amount. The second respondent is allowed to<\/p>\n<p>recover the amount from the first respondent.<\/p>\n<p id=\"p_6\">                                                  Sd\/=<br \/>\n                                              K.M.
