Khagaria -\n                                          Petitioner.\n                                            Versus\n                                        State Of Bihar\n                                           -----------\n<\/pre>\n<p id=\"p_1\">2        29.7.2011                       Heard learned counsel for the petitioner and the<\/p>\n<p>                             counsel appearing on behalf of the State.<\/p>\n<p id=\"p_1\">                                         The petitioner has challenged the order of discharge,<\/p>\n<p>                             dated 11.9.2008 passed in S.T. No. 463\/2008 by the Additional<\/p>\n<p>                             District and Sessions Judge, FTC V, Khagaria on the ground that<\/p>\n<p>                             no offence is made out under section307<a href=\"\/doc\/1569253\/\" id=\"a_1\"> of the Penal Code<\/a>.<\/p>\n<p id=\"p_2\">                                         The question as to whether <a href=\"\/doc\/455468\/\" id=\"a_1\">section 307<\/a> of the Penal<\/p>\n<p>                             Code would be applicable in the facts of the case will depend on<\/p>\n<p>                             the evidence that comes, the manner of occurrence, the nature of<\/p>\n<p>                             injuries and the weapons used.\n<\/p>\n<p id=\"p_3\">                                         All these aspects of the matter can well be examined<\/p>\n<p>                             by the court after the evidence is led in the case.<\/p>\n<p id=\"p_4\">                                         This application is disposed of with the aforesaid<\/p>\n<p>                             observation.\n<\/p>\n<p id=\"p_5\">\n<pre id=\"pre_1\">           haque                                                     ( Sheema Ali Khan, J.)\n <\/pre>\n","protected":false},"excerpt":{"rendered":"<p>Patna High Court &#8211; Orders Arun Prasad Bhushan vs State Of Bihar on 29 July, 2011 IN THE HIGH COURT OF JUDICATURE AT PATNA Cr.Misc.
