for a valuable consideration. .’lThe7._’_saJid site  —<\/p>\n

\nsale’  conveying the site at OMBR<\/p>\n
Layout (Alvternativeiljsi\u00e9te). The allottee was put in<\/p>\n
possession’ of the said site and issued with a possession<\/p>\n
‘ ,0″*i:e1’ti\ufb01cate”An.nexure–“M”. Since the property fell within<\/p>\n
.’ydt-11’eV.V  of the BBMP, the property was<\/p>\n
subjected to Corporation taxes. The 3rd petitioner<\/p>\n
”  it conveyed the site for a valuable consideration under the<\/p>\n
sale deed dated 28.05.2007 AnneXure–“R” executed in<\/p>\n
favour of the 1st and 2nd petitioners, jointly, who it is<\/p>\n

11.5.2009 Annexure–“U” addressed  th,_e”3:fd <\/p>\n
proposed to cancel thehtsitep on0″~th_eV .that the
\nallotment of the a1ternatep..sVite..Was in Violati\ufb01on of Rule
\nH–A (iii) of the BDA”(ix_iitot;n\u00a7%:ij.t  Rules, 1984 [for<\/p>\n
short ‘Ru1es_’};  The petitioiieigVvitesponded to the<\/p>\n
coIr;tn0\ufb01nieat_ion;’\u00a7V  representation dated
\n16.05.2009  indicating that he had no<\/p>\n
subsisting fright,  and interest in the property<\/p>\n
 A p:i:i’s%ia.n’t..&to itsvtmsale to the Petitioners 1 and 2. The<\/p>\n
  BDA, by communication dated 8.6.2009<\/p>\n
 cancelled the ailotment. Hence the<\/p>\n
V _ petition.\n<\/p>\n
3. Petition is opposed by filing Statement of<\/p>\n
objections dated ‘nil’ on 24.08.2010 of the respondent –<\/p>\n
BDA interaiia contending that after a detailed enquiry<\/p>\n

error\/ mistake in ailotting the alternative site at OMBR<\/p>\n

the hands of the officers of the B.D.A. <\/p>\n

violation V of “Rules, nevertheless, no material is<\/p>\n
  from either the show cause notice or in the<\/p>\n
i’   sjtaterrieiit ‘objection filed by the B.D.A.<\/p>\n
‘~  It is needless to state that the B.D.A. having<\/p>\n
 .Ve:l{ecuted the absolute sale deed conveying the site in<\/p>\n
 question in favour of the petitioner, is unable to support<\/p>\n
its action either under the provisions of the Bangalore<\/p>\n
Development Authority Act, 1976 or the Rules framed<\/p>\n

well as the sale deed. The cancellation of<\/p>\n
