This being fatal case,<br \/>\n\tclaimants have filed application under section 166 of MV Act before<br \/>\n\tclaims tribunal and during pendency of application under sec. 166 of<br \/>\n\tMV Act, 1988, claimants filed application under sec. 140 of MV Act<br \/>\n\tin aforesaid claim petitions claiming interim compensation and<br \/>\n\tclaims tribunal awarded Rs.50,000.00 on the basis of No Fault<br \/>\n\tLiability. Therefore, these appeals have been filed by appellant<br \/>\n\tinsurance company.\n<\/p>\n<p>Learned<br \/>\n\tAdvocate Mr. Mehta for appellant has raised contention objections<br \/>\n\twere filed by appellant insurance company by filign written<br \/>\n\tstatement at Exh. 30 and 29 but claims tribunal has not considered<br \/>\n\tsame. He submits that insurance company has raised statutory<br \/>\n\tdefences covered by sec. 149(2) of MV Act<br \/>\n\t          and also requested claims tribunal to consider and decide<br \/>\n\tsame but claims tribunal not considered or decided such statutory<br \/>\n\tdefences raised by insurance company.  He relied upon decision of<br \/>\n\tapex court in Yallwwa (Smt.) &amp; Others versus National Insurance<br \/>\n\tCompany &amp; Others reported in 2007 ACJ 1934 = 2007(6) SCC 657 and<br \/>\n\tsubmitted before this Court that it has been held by apex court that<br \/>\n\tif any objection has been raised by insurance company covered by<br \/>\n\tsection 149(2), then, claims tribunal must have to decide and<br \/>\n\texamine such objections even at the stage of application under sec.<br \/>\n\t140 of MV Act. Apart from that, application under sec. 166 of MV<br \/>\n\tAct, 1988 filed by claimant is pending before claimants.\n<\/p>\n<p>Considering<br \/>\n\tthese submissions made by learned Advocate Mr. Mehta for appellant,<br \/>\n\taccording to my opinion, claims tribunal has not considered<br \/>\n\tstatutory defence raised by insurance company, however, according to<br \/>\n\tmy opinion,  admission of this appeal would be having no meaning<br \/>\n\tbecause it will have to wait upto decision in an application under<br \/>\n\tsection 166 of  MV Act, therefore, it is better to dispose of this<br \/>\n\tappeal without expressing any opinion on merits while directing<br \/>\n\tclaims tribunal to examine application under section 166 of MV Act,<br \/>\n\t1988 and to examine and consider objections raised by insurance<br \/>\n\tcompany in accordance with law with a further direction to claims<br \/>\n\ttribunal not to permit claimant to withdraw application under<br \/>\n\tsection 166 of MV Act and claimant cannot abandon such proceedings.<br \/>\n\tIf these appeals are  disposed of without expressing any opinion on<br \/>\n\tmerits while directing claims tribunal to decide main application of<br \/>\n\tclaimants in both appeals under sec. 166 of MV Act as expeditiously<br \/>\n\tas possible,  it would met ends of justice between the parties.\n<\/p>\n<p>In<br \/>\n\tview of these facts, these appeals are disposed of without<br \/>\n\texpressing any opinion on merits. Claims tribunal concerned is<br \/>\n\tdirected to decide main application under sec. 166 of MV Act, 1988<br \/>\n\tas expeditiously as possible in accordance with law after hearing<br \/>\n\tparties before it. Appellant insurance company is directed to<br \/>\n\tdeposit entire awarded amount together with costs and interest in<br \/>\n\teach claim petition before claims tribunal within one month from the<br \/>\n\tdate of receipt of copy of this order. After realizing amounts from<br \/>\n\tinsurance company, claims tribunal is directed to pay 30% amount to<br \/>\n\tclaimants by way of an account payee cheque drawn in his favour and<br \/>\n\trest of the amount is ordered to be invested in any nationalized<br \/>\n\tbank for a period of three years, to be renewed from time to time<br \/>\n\twith cumulative interest , in the name of respondent claimant but<br \/>\n\tFDRs to remain in custody of Nazir of the Claims Tribunal concerned<br \/>\n\tand claimant will not be entitled to any interest upon such FDRs<br \/>\n\ttill application under section 166 of MV Act, 1988 is decided by<br \/>\n\tclaims tribunal in accordance with law. Claims Tribunal is further<br \/>\n\tdirected not to permit withdrawal of application under sec. 166 of<br \/>\n\tMV Act and claimant shall not abandon proceedings of an application<br \/>\n\tunder sec. 166 of MV Act, 1988 but shall have to get it decided on<br \/>\n\tmerits by claims tribunal and claims tribunal shall decide<br \/>\n\tapplication under sec. 166 of MV Act as expeditiously as possible,<br \/>\n\tstrictly in accordance with law after examining objections raised by<br \/>\n\tinsurance company without being influenced by award of claims<br \/>\n\ttribunal under sec. 140 of MV Act, as well as present order passed<br \/>\n\tby this court.\n<\/p>\n<p>With<br \/>\n\tthese observations and directions, these appeals are disposed of<br \/>\n\twithout expressing any opinion on merits.\n<\/p>\n<p>Since<br \/>\n\tfirst appeals have been disposed of by this court, no order is<br \/>\n\trequired to be passed on civil applications for stay, therefore,<br \/>\n\tcivil applications for stay are also disposed of accordingly.\n<\/p>\n<p>(H.K.\n<\/p>\n<p>Rathod,J.)<\/p>\n<p>Vyas<\/p>\n<p>\t\t   \u00a0\u00a0\u00a0<\/p>\n<p>\t\t   Top<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Gujarat High Court Royal vs Mehul on 24 March, 2011 Author: H.K.Rathod,&amp;Nbsp;
