JOSEPH FRANCIS, J.\n              - - - - - - - - - - - - - - - - - - - - - -\n               Crl.R.P.No. 218 of 2004\n              - - - - - - - - - - - - - - - - - - - - - -\n          Dated this the 8th day of April, 2009\n\n                           O R D E R\n<\/pre>\n<p id=\"p_1\">      This Revision Petition is filed by the accused in<\/p>\n<p>C.C.421 of 1998 on the file of the J.F.C.M. Court-III,<\/p>\n<p>Kottayam.    C.C.421 of 1998 is a case charge sheeted by<\/p>\n<p>the Sub Inspector of Police, West Police Station, Kottayam<\/p>\n<p>against the accused under <a href=\"\/doc\/162506\/\" id=\"a_1\">Sections 447<\/a>, <a href=\"\/doc\/724142\/\" id=\"a_1\">324<\/a> and <a href=\"\/doc\/1540253\/\" id=\"a_2\">326<\/a> I.P.C.<\/p>\n<p id=\"p_1\">      2. The prosecution case is briefly as follows. On<\/p>\n<p>15.11.1998 at about 10.15 a.m., while PW1 was digging<\/p>\n<p>his property on the northern side of his house for<\/p>\n<p>cultivation, the accused came there and obstructed him<\/p>\n<p>saying that it was the pathway for him.                  When PW1<\/p>\n<p>continued his work, the accused attacked him by using<\/p>\n<p>MO1, handle of a spade. When PW2, the wife of PW1,<\/p>\n<p>intervened, the accused assaulted her also by MO1.<\/p>\n<p id=\"p_2\">      3.   In the Magistrate Court, on the side of the<\/p>\n<p>prosecution, PWs. 1 to 8 were examined and Exts.P1 to P3<\/p>\n<p>Crl.R.P.No. 218 of 2004<br \/>\n<span class=\"hidden_text\" id=\"span_1\">                                   2<\/span><\/p>\n<p>  were marked. MOs. 1 and 2 were identified. No evidence was<\/p>\n<p>  adduced from the side of the defence.\n<\/p>\n<p id=\"p_3\">         4. The learned Magistrate, on considering the evidence,<\/p>\n<p>  found the accused guilty under <a href=\"\/doc\/724142\/\" id=\"a_3\">Section 324<\/a> I.P.C. only and he<\/p>\n<p>  was convicted and sentenced to undergo S.I. for a period of six<\/p>\n<p>  months and to pay a fine of Rs.1,000\/- and in default to undergo<\/p>\n<p>  S.I. for one month.\n<\/p>\n<p id=\"p_4\">         5. Against that conviction and sentence, the accused filed<\/p>\n<p>  Crl.A.No.430 of 2002 before the Sessions Court, Kottayam,<\/p>\n<p>  which was allowed in part. The conviction of the accused under<\/p>\n<p>  <a href=\"\/doc\/724142\/\" id=\"a_4\">Section 324<\/a> I.P.C. was confirmed, but the sentence was<\/p>\n<p>  converted into a fine of Rs.5,000\/- and in default to undergo S.I.<\/p>\n<p>  for a period of three months. Against that judgment the accused<\/p>\n<p>  filed this revision petition.\n<\/p>\n<p id=\"p_5\">         6. Heard the learned counsel for the revision petitioner<\/p>\n<p>  and the learned counsel for the respondent.<\/p>\n<p id=\"p_6\">         7. Learned counsel for the revision petitioner submitted<\/p>\n<p>  that the petitioner is not questioning the conviction under<\/p>\n<p>Crl.R.P.No. 218 of 2004<br \/>\n<span class=\"hidden_text\" id=\"span_1\">                                   3<\/span><\/p>\n<p>  <a href=\"\/doc\/724142\/\" id=\"a_5\">Section 324<\/a> I.P.C. and that the only prayer is to reduce the fine,<\/p>\n<p>  as the accused has no ability to pay Rs.5,000\/-<\/p>\n<p id=\"p_7\">         8. The defacto complainant was examined as PW1. He<\/p>\n<p>  swears that on 15.4.1998 at about        10 a.m., while he was<\/p>\n<p>  carrying on agricultural operations in his property behind the<\/p>\n<p>  house, the accused came there and there was an altercation<\/p>\n<p>  between them with regard to the right of the pathway and the<\/p>\n<p>  accused beat him with the handle of a spade on his left elbow<\/p>\n<p>  and forehead. When PW2, the wife of PW1, intervened, the<\/p>\n<p>  accused assaulted her also. PW2 also gives more or less the<\/p>\n<p>  same version regarding the occurrence. PW4 is an independent<\/p>\n<p>  eye witness, who also supports the prosecution case. Ext.P3 is<\/p>\n<p>  the wound certificate showing that PW1 sustained only minor<\/p>\n<p>  injuries in the occurrence. Since the testimony of PWs. 1, 2 and<\/p>\n<p>  4 is reliable and corroborating each other on material particulars<\/p>\n<p>  and duly corroborated by the medical evidence, I am of the view<\/p>\n<p>  that the Magistrate Court and the Appellate Court are fully<\/p>\n<p>  justified in convicting the accused under <a href=\"\/doc\/724142\/\" id=\"a_6\">Section 324<\/a> I.P.C.<\/p>\n<p>Crl.R.P.No. 218 of 2004<br \/>\n<span class=\"hidden_text\" id=\"span_2\">                                   4<\/span><\/p>\n<p id=\"p_8\">        9. The learned counsel for the petitioner submitted that the<\/p>\n<p>  accused and PW1 are neighbours and close relatives and that the<\/p>\n<p>  accused has no ability to pay the fine amount of Rs.5,000\/-<\/p>\n<p>  Therefore the fine may be reduced.\n<\/p>\n<p id=\"p_9\">        10. Considering the facts and circumstances of the case<\/p>\n<p>  and all aspects of the matter, I am of the view that the ends of<\/p>\n<p>  justice would be met by reducing the fine amount as Rs.1,000\/-<\/p>\n<p>  and in default to undergo S.I. for a period of one month.<\/p>\n<p id=\"p_10\">        11. This Revision Petition is accordingly allowed in part.<\/p>\n<p>  The conviction of the accused in C.C. 421 of 1998 on the file of<\/p>\n<p>  the J.F.C.M. Court-III, Kottayam under <a href=\"\/doc\/724142\/\" id=\"a_7\">Section 324<\/a> I.P.C. is<\/p>\n<p>  confirmed. But the sentence is modified and the accused is<\/p>\n<p>  sentenced to pay fine of Rs.1,000\/- and in default to undergo S.I.<\/p>\n<p>  for a period of one month.
