JUSTICE ABHILASHA KUMARI\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 29\/01\/2010 \n\n \n\n \nORAL\nORDER<\/pre>\n<p id=\"p_1\">\tRule.\n<\/p>\n<p id=\"p_1\">Mr.Maulik G.Nanavati, learned Additional Public Prosecutor, waives<br \/>\nservice of notice of Rule on behalf of the respondent.\n<\/p>\n<p id=\"p_2\">\tThis<br \/>\napplication has been filed with a<br \/>\nprayer to extend the time-limit for a further period of four weeks to<br \/>\nreturn the Passport of the applicant to the Trial Court, as directed<br \/>\nby order dated 11.12.2009 passed in Criminal Misc. Application<br \/>\nNo.13605 of 2009 in Criminal Misc. Application No.5487 of 2009.\n<\/p>\n<p id=\"p_3\">\tBy<br \/>\norder dated 11.12.2009 passed in Criminal Misc. Application No.13605<br \/>\nof 2009 in Criminal Misc. Application No.5487 of 2009, the applicant<br \/>\nhad been directed to make an application to the Trial Court regarding<br \/>\nhanding over of his Passport to the British High Commission for<br \/>\nprocessing of the VISA. By the said order, the applicant had been<br \/>\ndirected to return the Passport to the Trial Court within a period of<br \/>\n45 days from the date on which it is handed over to him.\n<\/p>\n<p id=\"p_4\">\tIt<br \/>\nis submitted by Mr.Premal R. Joshi, learned counsel for the applicant<br \/>\nthat the Passport has not been returned to the applicant by the<br \/>\nBritish High Commission. Therefore, time to return the Passport to<br \/>\nthe Trial Court may be extended.\n<\/p>\n<p id=\"p_5\">\tMr.Maulik<br \/>\nG.Nanavati, learned Additional Public Prosecutor, has submitted that<br \/>\nthe applicant may be directed to return the Passport<br \/>\nto the Trial Court within a period of two days after it is made<br \/>\navailable to him and the Court may also fix some outer time-limit<br \/>\nbeyond which, the period of time may not be extended.\n<\/p>\n<p id=\"p_6\">\tHaving<br \/>\nheard the learned counsel for the respective parties and having<br \/>\nconsidered the submissions made at the Bar, the interest of justice<br \/>\nwould demand that the prayer made in the application is granted,<br \/>\nthough with certain conditions.\n<\/p>\n<p id=\"p_7\">\tAccordingly,<br \/>\nit is directed that the time for return of the Passport to the Trial<br \/>\nCourt by the applicant is extended upto 27.02.2010. However, it is<br \/>\nmade clear that if the Passport is made available to the applicant<br \/>\nbefore this date, he shall hand it over to the Trial Court<br \/>\nimmediately and not later than three days from the receipt thereof.<br \/>\nThe other conditions in order dated 11.12.2009 shall remain the same.\n<\/p>\n<p id=\"p_8\">\tThe<br \/>\napplication is disposed of, as above. Rule is made absolute to the<br \/>\nabove extent.
