L.B.DABHI, APP for Respondent(s) :\n1, \n========================================= \n\n \n\t  \n\t \n\t  \n\t\t \n\t\t\t \n\nCORAM\n\t\t\t: \n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE A.M.KAPADIA\n\t\t\n\t\n\t \n\t\t \n\t\t\t \n\n \n\n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nand\n\t\t\n\t\n\t \n\t\t \n\t\t\t \n\n \n\n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE J.C.UPADHYAYA\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 16\/08\/2010 \n\n \n\n \nORAL\nORDER<\/pre>\n<p id=\"p_1\">(Per<br \/>\n: HONOURABLE MR.JUSTICE A.M.KAPADIA)<\/p>\n<p>RULE.\n<\/p>\n<p id=\"p_1\">MR.\n<\/p>\n<p id=\"p_2\">\tL.B.Dabhi, learned APP appears and waives service of notice on<br \/>\n\tbehalf of the Respondent   State of Gujarat.\n<\/p>\n<p id=\"p_3\">By<br \/>\n\tmeans of filing this application under <a href=\"\/doc\/100581\/\" id=\"a_1\">Section 5<\/a> of the Limitation<br \/>\n\tAct, 1963 (&#8216;the Act&#8217; for short), the Applicant   accused has<br \/>\n\tprayed to condone  delay of 215 days  caused in filing the  Criminal<br \/>\n\tAppeal No. 1371 of 2010, which is directed against the judgment and<br \/>\n\torder dated 29.10.2009 rendered in Sessions Case No.90 of 2004, by<br \/>\n\tthe learned Additional Sessions Judge and Presiding Officer, Fast<br \/>\n\tTracks Court No.2, Jamnagar, by which the Applicant   Appellant<br \/>\n\tNo.1 (original accused no.1   Jayaben) has been convicted for the<br \/>\n\toffences punishable under <a href=\"\/doc\/257920\/\" id=\"a_1\">Section 489C<\/a> of the Indian Penal Code and<br \/>\n\tsentenced to suffer RI for 5 years and fine of Rs.10,000\/- and in<br \/>\n\tdefault of payment of fine, further SI for 4 months, whereas<br \/>\n\tApplicant   Appellant No.2 (original accused no.2   Kishan) has<br \/>\n\tbeen convicted for the offences punishable under <a href=\"\/doc\/591351\/\" id=\"a_2\">Sections 489A<\/a>,<br \/>\n\t<a href=\"\/doc\/1926477\/\" id=\"a_3\">489B<\/a>, <a href=\"\/doc\/257920\/\" id=\"a_4\">489C<\/a> and <a href=\"\/doc\/193831\/\" id=\"a_5\">489D<\/a> of the Indian Penal Code and sentenced to suffer<br \/>\n\tRI of 10 years, RI for 10 years, RI for 7 years and RI for 10 years<br \/>\n\trespectively and total fine of Rs.40,000\/- with usual default<br \/>\n\tclause.\n<\/p>\n<p id=\"p_4\">The<br \/>\n\treasons as to why the appeal could not be filed in time are detailed<br \/>\n\tin paragraph 2 of the application, wherein inter alia it is stated<br \/>\n\tthat the Applicants are in jail from the date of their arrest, i.e.<br \/>\n\tat pretrial stage.  They have got three daughters residing at Rajkot<br \/>\n\t.  The entire case papers, copies of evidence and documentary<br \/>\n\tevidence were with the Advocate on record.  The Applicants could not<br \/>\n\tget back the case papers from the Advocate of the trial Court,<br \/>\n\texcept the copy of the judgment of conviction and sentence.  Besides<br \/>\n\tthis, it is also asserted that Applicant   Appellant No.2<br \/>\n\t(original accused no.2) is suffering from various ailments of<br \/>\n\tProstate and she is provided treatment in jail and therefore the<br \/>\n\tApplicants could not approach the Advocate.  However, with the help<br \/>\n\tof one of the prisoners, they contacted the Advocate who instructed<br \/>\n\tto file Appeal, and therefore, delay has been caused.  It is<br \/>\n\ttherefore, prayed that the delay may be condoned. Besides this, it<br \/>\n\tis also asserted that the Applicants have a good prima facie and<br \/>\n\tmeritorious case in their favour.\n<\/p>\n<p id=\"p_5\">Having<br \/>\n\tconsidered the submissions advanced by Mr. Viral Vyas, learned<br \/>\n\tAdvocate for the Applicants and Mr. Mr.L.B.Dabhi, learned APP, for<br \/>\n\tthe Respondent   State of Gujarat and a perusal of the averments<br \/>\n\tmade in the Application which have remained uncontroverted, and also<br \/>\n\tconsidering the celebrated principles governing the discretionary<br \/>\n\texercise of power conferred under <a href=\"\/doc\/100581\/\" id=\"a_6\">Section 5<\/a> of the Act so also the<br \/>\n\treported decisions of the Hon&#8217;ble Supreme Court construing <a href=\"\/doc\/100581\/\" id=\"a_7\">Section 5<\/a><br \/>\n\tof the Act liberally, we are of the considered  opinion that delay<br \/>\n\tcaused in filing the appeal has been aptly, elaborately and<br \/>\n\tsufficiently explained. The record does not indicate that there was<br \/>\n\tinaction or negligence on the part of the Applicants in prosecuting<br \/>\n\tthe appeal. The Applicants have never abandoned the lis. The<br \/>\n\texplanation offered for condonation of delay is not only plausible,<br \/>\n\tbut acceptable. In the aforesaid view of the matter, since there was<br \/>\n\tsufficient cause which prevented the Applicants in filing the Appeal<br \/>\n\tin time, application deserves to be allowed by condoning the delay<br \/>\n\tas prayed for.\n<\/p>\n<p id=\"p_6\">For<br \/>\n\tthe foregoing reasons, the application succeeds and accordingly it<br \/>\n\tis allowed. Delay of 215 days caused in filing the appeal is<br \/>\n\tcondoned.
