PATTANAIK (J)\n\n\n\n\nACT:\n\n\n\nHEADNOTE:\n\n\n\nJUDGMENT:\n<\/pre>\n<p>\t\t\t O R D E R<br \/>\n     Delay condoned.\n<\/p>\n<p>     The petitioner  complains that  he\t being\ta  qualified<br \/>\ncandidate  with\t  Diploma  in\tEngineering  and   Secondary<br \/>\nEducation  had\tapplied\t for  the  post\t of  Oversear\/Junior<br \/>\nEngineer (Civil\t Engineering) as per the advertisement dated<br \/>\nApril 30,  1991 published  in daily &#8216;Tarun Bharat&#8217; on May 2,<br \/>\n1991. The  advertisement indicated  that of the 3 posts, two<br \/>\nwere reserved  for backward  classes and one was for general<br \/>\ncandidates. Petitioner\tbeing a reserved class, hailing from<br \/>\nthe Scheduled  Caste, received\tletter of  appointments from<br \/>\nthe  Chairman,\tChief  Executive  Officer,  Zilla  Parishad,<br \/>\nGadchiroli; in\tletter No.  PWB\/Estt-I\/1108\/1\/93 dated March<br \/>\n31, 1993  it was  stated that a recommendation had been made<br \/>\nby Member  Secretary, Regional Subordinate Service Selection<br \/>\nBoard, Nagpur in their letter No. RSB\/Nag\/1210\/M-792\/PS-1\/92<br \/>\ndated June  15, 1992  that 3  candidates were  selected. The<br \/>\nnames had  been repeated  and as regards the petitioner, his<br \/>\nrecommendation letter  No.RSB\/Nag\/1160\/M-792\/1992\/PS-I dated<br \/>\nJuly 31,  1992\/7.8.92 was  said to  be issued  by the Member<br \/>\nSecretary  selecting   the  petitioner\tas  Junior  Engineer<br \/>\n(Civil). Pursuant  thereto, he\tcame to\t be appointed  as  a<br \/>\nJunior\tEngineer   with\t probation   for  one\tyear.  After<br \/>\ncompletion of  nine months  service, he\t received the letter<br \/>\ndated November\t15, 1992  stating  therein  that  the  above<br \/>\nletters carried unauthorised recommendations; therefore, the<br \/>\nservices of the petitioner were terminated. The order of the<br \/>\nChief Executive\t Officer,  Zilla  Parishad,  Gadchiroli\t was<br \/>\nimpugned by  the petitioner  and others in the W.P.No.885\/93<br \/>\nin the High Court of Bombay, Nagpur Bench claiming that they<br \/>\nhad  been  regularly  appointed\t to  the  posts\t which\twere<br \/>\nadvertised;  therefore,\t  their\t services   could   not\t  be<br \/>\nterminated during  the probation  period  without  affording<br \/>\nopportunity of\thearing in  the enquiry.  The High Court has<br \/>\ndismissed  the\twrit  petition.\t Thus,\tthis  special  leave<br \/>\npetition.\n<\/p>\n<p>     Shri A.K.\tSanghi, learned\t counsel for the petitioners<br \/>\nhas contended  that when  the posts  were advertised and the<br \/>\ncandidates were\t found eligible,  it does  not mandate\tthat<br \/>\nthere should  be an  interview and  selection Obviously, the<br \/>\nServicc Selection  Board having\t found the  petitioner to be<br \/>\neligible and  qualified, recommended him and was accordingly<br \/>\nappointed as  Junior Engineer,\twhen it\t was  sought  to  be<br \/>\ncancelled on  a letter\twritten by  Member Secretary  of the<br \/>\nService Selection  Board, they\tare entitled to be heard. No<br \/>\nsuch opportunity  has ever been given before cancellation of<br \/>\ntheir  appointments.   lt  was,\t  therefore,  violative\t  of<br \/>\nprinciples of  natural justice.\t We find  no  force  in\t the<br \/>\ncontention. It is seen that on their own admission they have<br \/>\nmerely applied\tfor the\t post pursuant\tto an  advertisement<br \/>\nmade for  the selection.  It is\t the case  of the  Selection<br \/>\nBoard that  a regular selection has to be made and selecting<br \/>\nthe  eligible  candidates,  recommendation  for\t appointment<br \/>\nwould be  made. Therefore, the letter said to be recommended<br \/>\nconveying the  eligible recommendations were not correct and<br \/>\naccording  to\tthe  rules  when  such\tbeing  the  admitted<br \/>\nposition,  we\tdo  not\t  find\tany   fault  to\t cancel\t the<br \/>\nappointments. Under  those circumstances, we do not find any<br \/>\nillegality in  the action taken by the respondents. However,<br \/>\nsuch things  will not  be permitted  to be  kept  under\t the<br \/>\ncarpet. The State Government is directed to refer the matter<br \/>\nto the\tappropriate State  CBI\tenquiry\t and  the  concerned<br \/>\nInspector would\t make and independent investigation into the<br \/>\nmatter to  find out  to who  were responsible  for such mal-<br \/>\npractice committed  and it  will be open to take appropriate<br \/>\ncriminal prosecution launched against the culprits.\n<\/p>\n<p>     The SLP  is dismissed. This order to be communicated to<br \/>\nthe D.G.P.
