2\/   19-11-2010             Heard the parties.\n<\/p>\n
                            The petitioners apprehend their arrest in a<\/p>\n
                  criminal prosecution for offence under section 307\/34 and<\/p>\n
                  some other allied offences under the Indian Penal Code<\/a>.<\/p>\n
                            It is submitted that the petitioners are named in<\/p>\n
                  the F.I.R. and there is allegation of assault against them<\/p>\n
                  also besides others. It is also submitted that there is<\/p>\n
                  counter version from the side of the accused persons, vide<\/p>\n
                  Annexure-3. However, on close of investigation the police<\/p>\n
                  has submitted final form vide Annexure-2 for offences<\/p>\n
                  under section 341<\/a>, 323<\/a>, 325<\/a>, 447<\/a> and 504<\/a> of the Indian<\/p>\n
                  Penal Code, which all are bailable. In that view of the<\/p>\n
                  matter, the petitioners were granted bail by the police in<\/p>\n
                  terms of section 436(1)<\/a> Cr. P. C. However, subsequently,<\/p>\n
                  the learned Magistrate disagreed with the police report and<\/p>\n
                  has taken cognizance under sections 341<\/a>, 323<\/a>, 325<\/a>, 447<\/a>,<\/p>\n
                  504<\/a> and 307<\/a> of the Indian Penal Code. Hence, this<\/p>\n
                  application for anticipatory bail.\n<\/p>\n
                            Learned counsel for the State has opposed the
\n                  2<\/span><\/p>\n
prayer for anticipatory bail and has submitted that since<\/p>\n
the petitioners had surrendered before the police and were<\/p>\n
on police bail, therefore, the present application for<\/p>\n
anticipatory bail is not maintainable. Learned counsel for<\/p>\n
the State appears to be correct.\n<\/p>\n
          The present anticipatory bail application is not<\/p>\n
maintainable in the facts and circumstances stated above.<\/p>\n
However, there is no allegation that after grant of bail by<\/p>\n
the police, the petitioners have misused the privilege of<\/p>\n
bail. Similar matters came up for consideration before this<\/p>\n
Court in case of Mahendra Prasad Singh Vrs. The State<\/p>\n
of Bihar, reported in 2004 (3) PLJR 491 as also in the<\/p>\n
case of Jagnarayan Yadav @ Babajee Yadav and others<\/p>\n
Vrs. State of Bihar, reported in 2010(2) PLJR- 684 and<\/p>\n
in those cases, it was held that though petition for<\/p>\n
anticipatory bail was not maintainable, but once such<\/p>\n
accused persons surrender in the court below, then their<\/p>\n
prayer for regular bail was required to be considered<\/p>\n
favourably.\n<\/p>\n
          In the light of the observations made in those two<\/p>\n
cases, namely, Mahendra Prasad Singh (Supra) and<\/p>\n
Jagnarayan Yadav @ Babajee Yadav and others (Supra),<\/p>\n
the present application is disposed of with a direction to<\/p>\n
the petitioners to surrender in the court below in<\/p>\n
connection with Patahi P.S. Case No. 13 of 2010, pending
\n                                 3<\/span><\/p>\n
           in the court of learned Subdivisional Judicial Magistrate,<\/p>\n
           East Champaran, within a period of four weeks from today<\/p>\n
           and on their surrender, their prayer for regular bail shall<\/p>\n
           be disposed of in the light of observations in the judgments<\/p>\n
           referred to above.\n<\/p>\n
                     Let this order be communicated through fax at<\/p>\n
           the cost of the petitioners.\n<\/p>\n
