(3)  55\n 1991 SCC  (1) 397\t  JT 1990 (4)\t399\n 1990 SCALE  (2)1000\n\n\nACT:\n    <a href=\"\/doc\/1396751\/\" id=\"a_1\">Contempt  of  Courts  Act<\/a>--<a href=\"\/doc\/1121027\/\" id=\"a_1\">Sections\t 3<\/a>  and\t <a href=\"\/doc\/1686702\/\" id=\"a_2\">19-<\/a>-Court's\norders-Compliance  of  utmost vigilance to be  exercised  by\nofficers of Government.\n\n\n\nHEADNOTE:\n    The appellant, an officer of the State Government, while\nacting as Junior Land Reforms Officer-cum-Block\t Development\nOfficer,  was  enjoined\t to  comply  with  the\tOrder  dated\n15.6.1987 passed by the Calcutta High Court, restraining the\nRespondent-State from interfering with the possession of the\nwrit-petitioners  in respect of the disputed lands and\tfrom\ncultivating the said lands. The appellant was duly  apprised\nwith  the  said order and as a result  thereof\tBlock  Level\nCoOrdination  Committee\t met  and  passed  a  resolution  on\n20.7.1987  that the Officer-in-charge of the Kultuli  Police\nStation should take necessary action according to the  order\nof  the\t Hon' High Court. The appellant was a party  to\t the\nsaid resolution. Despite that on 3.8.1987, he issued a\tmemo\nto  the\t Officer-in-charge  of the  Kultuli  Police  Station\nintimating that the pattaholders mentioned in the memo\twere\nentitled  to  cultivate the lands in dispute  and  that\t the\npolice help to the pattaholders be given during the cultiva-\ntion period. This memo was directly and clearly in violation\nof  the\t injunction  order passed by the High  Court.  On  a\ncontempt petition filed before the High Court, the appellant\nwas  found  guilty of contempt of court and the\t High  Court\nrejecting  the\tapology tendered by him, imposed a  fine  of\nRs.1,O00.  Being  aggrieved the appellant moved\t a  petition\nbefore this Court, which was originally registered as  Peti-\ntion  for Special leave and was dismissed by this  Court  on\n23.10.89. Thereafter, on being pointed out that the petition\nshould have been treated as an appeal petition under <a href=\"\/doc\/1686702\/\" id=\"a_3\">section\n19<\/a>  of\tthe Contempt of Courts Act, the\t Court\trecalled  it\nearlier\t order dated 23.10.89 and directed that SLP  be\t re-\nnumbered  as a Criminal Appeal and that is now\tthe  instant\nappeal has come up for hearing.\n    The\t appellant contended that the memo dated 3.8.87\t had\nbeen inadvertently signed by him as it was one of the sever-\nal  memos which he had to issue in connection  with  various\ndisputes regarding cultivation rights during the cultivation\nseason. On the other hand the respondents\n56\ncontended  that they had been litigating against  the  State\nsince 1963 as the State had granted pattas in respect of the\ndisputed  lands\t to others disregarding their right  to\t the\nland  and  the\tappellant had been acting  contrary  to\t the\ninterests of the respondents in the said litigation.\nAllowing the appeal, this Court,\n    HELD:  Having decided, as a member of the  B.L.C.C.,  to\ngive police protection to the respondents, the appellant was\nnot likely to have taken action deliberately to go  contrary\nto the decision of the Committee and flout the order of\t the\nCourt. The possibility that there was some mistake or  inad-\nvertence  due  to pressure of work cannot be  totally  ruled\nout. [59F]\n    Officers of Government should exercise utmost  vigilance\nin  compliance\tof courts' orders, particularly\t where\tthey\ndeal  with vital issues such as cultivation rights of  land-\nholders. [60E]\n    In the present case, the appellant himself withdrew\t his\nletter\tdated 3.8.87 and police protection was\tprovided  to\nthe respondents. But such lapses, even during a short inter-\nval,  can  sometimes cause irreparable\tdamage\tand  injury.\n[60F]\n    Where  a  case of wilful disobedience is made  out,\t the\ncourts\twill  not hesitate and will convict  the  delinquent\nofficer\t and no lenience in the court's attitude  should  be\nexpected from the court as a matter of course merely on\t the\nground that an order of conviction would damage the  service\ncareer of the concerned officer.
