Lakhisarai, District Lakhisarai.\n                                                ------- Petitioner\n                               Versus\nThe State of Bihar                               ----- Opp. Party\n                            -----------\n<\/pre>\n<p id=\"p_1\">3       13.08.2010              Heard       learned        counsel       for        the<\/p>\n<p>                     petitioner and counsel for the State.<\/p>\n<p id=\"p_1\">                                Earlier the prayer for bail of the<\/p>\n<p>                     petitioner       was      rejected         by    order      dated<\/p>\n<p>                     14.12.2009 in Cr. Misc. No. 35955 of 2009<\/p>\n<p>                     with a condition that the petitioner would be<\/p>\n<p>                     released    on     bail    only       if    he   has     got   no<\/p>\n<p>                     criminal antecedent.\n<\/p>\n<p id=\"p_2\">                                Counsel      for     the        petitioner       would<\/p>\n<p>                     submit that since there was only one criminal<\/p>\n<p>                     case against the petitioner under <a href=\"\/doc\/361626\/\" id=\"a_1\">Section 7<\/a><\/p>\n<p>                     of   the     Essential          Commodities         Act,       the<\/p>\n<p>                     petitioner    could       not    be    released        on   bail<\/p>\n<p>                     despite an order in his favour.<\/p>\n<p id=\"p_3\">                                The petitioner is in custody since<\/p>\n<p>                     29.7.2009 and has thus completed one year of<\/p>\n<p>                     judicial custody.\n<\/p>\n<p id=\"p_4\">                            Considering            this         aspect      as    also<\/p>\n<p>                     keeping in view the earlier order of this<\/p>\n<p>                     Court dated 14.12.2009 in Cr. Misc. No. 35955<br \/>\n<span class=\"hidden_text\" id=\"span_1\">                  2<\/span><\/p>\n<p>of 2009, this Court would direct for release<\/p>\n<p>of the petitioner, namely, Pankaj Kumar Gupta<\/p>\n<p>on     bail    on     furnishing       bail     bond     of     Rs.<\/p>\n<p>10,000\/- (ten thousand) with two sureties of<\/p>\n<p>the like amount each to the satisfaction of<\/p>\n<p>Chief     Judicial          Magistrate,       Lakhisarai         in<\/p>\n<p>connection with Lakhisarai P.S. Case No. 305<\/p>\n<p>of 2009 (G.R. No. 668 of 2009), subject to<\/p>\n<p>the following conditions:-\n<\/p>\n<p id=\"p_5\">          (i)        The    two     bail     bonds      will    be<\/p>\n<p>furnished, one by the Government servant and<\/p>\n<p>the other by a close family relative.<\/p>\n<p id=\"p_6\">              (ii)     The     petitioner        will     remain<\/p>\n<p>present in course of trial on each and every<\/p>\n<p>day and his absence even for a single day<\/p>\n<p>would automatically entail the consequences<\/p>\n<p>of cancellation of his bail.\n<\/p>\n<p id=\"p_7\">          (iii) The petitioner in case is now<\/p>\n<p>made     accused       in     any    other    criminal         case<\/p>\n<p>except one under <a href=\"\/doc\/361626\/\" id=\"a_1\">Section 7<\/a> of the Essential<\/p>\n<p>Commodities          Act,    as     indicated    above,        that<\/p>\n<p>would    itself        lead    to     cancellation       of    his<\/p>\n<p>bail.\n<\/p>\n<p id=\"p_8\">              Subject         to      the     aforementioned<\/p>\n<p>conditions,          the     prayer     for     bail     of    the<br \/>\n<span class=\"hidden_text\" id=\"span_1\">                  3<\/span><\/p>\n<p>      petitioner is allowed.\n<\/p>\n<p id=\"p_9\">\n<pre id=\"pre_1\">Rsh                            (Mihir Kumar Jha, J.)\n <\/pre>\n","protected":false},"excerpt":{"rendered":"<p>Patna High Court &#8211; Orders Pankaj Kumar Gupta vs The State Of Bihar on 13 August, 2010 IN THE HIGH COURT OF JUDICATURE AT PATNA Cr.Misc.
