On 04.05.2008, on Madhava Mudaliyar road when the
\nclaimant was riding a bicycle near seppings junction the
\ndriver of the BMTC bus bearing No.KA~–01~FA–858 drove the<\/p>\n
same in a rash and negligent manner and dashed<\/p>\n
him. As a result, he fell down and sustained inju.1jies.4. *<\/p>\n
he \ufb01led a claim petition before the  ll<\/p>\n
compensation of Rs.4,00,000\/–. The T <\/p>\n
compensation of Rs.2,73,200\/\u00ab~ wit’h_jintere.s’t\u00bb_at \u20ac59:\/of   <\/p>\n
5. As there is no ‘-dispute ;_;:ega.rdi”ng occurrence of<\/p>\n
accident, negligencesand  ‘l.tlie:””.1,i.1isurer of the<\/p>\n
offending xfehicle,0″t1’ie:”ion’ly”—–._p’oilnt that arises for my
\nconsideration insthevvappeal <\/p>\n
 twhether”–the___compensation awarded by the
\n:Triblunal.0pis:just and reasonable or does it call for
\nI =enl.1anoeinen <\/p>\n
6.AAfter.V0′.l’1earing the learned counsel appearing for<\/p>\n
lpartiesz ‘a.,-and perusing the judgment and award of the<\/p>\n
 Tarn of the View that the compensation awarded by<\/p>\n
 . _ 0ti1e”i”*ri’bunaI is not just and reasonable, it is on the lower side<\/p>\n
 hence, it is required to be enhanced.<\/p>\n
7. The claimant has sustained the following ir1jur’ies:~\u00bb<\/p>\n
a) Fracture of left lower radius collies fracture   ~
\nb} Laceration on right arm  “ff:  V
\nc} Fracture of lateral apicondyie right hume_rt:.s. V <\/p>\n
The injuries sustained by the clairnant are eyideritll<\/p>\n
the wound certificate Ex.P–5, case  x-
\nrays ~ EXP55 to 63 and  evidence of the
\nclaimant and doctor,y who ‘_i.PWs–1 and 2
\nrespectively. PW~2:_f”   his evidence that
\non 04.05.2008  Polyclinic and
\nNursing Horne__ of left lower radius
\ncollies fracturemand conservatively. From
\n0yy4\u00a2,05.20.0%$l ‘to it 0s..l0s.200s and from 30.05.2008 to<\/p>\n
lie-further stated that the claimant has suffered<\/p>\n
  15% a1s;amityllta;vho:e body.\n<\/p>\n
 ucotnsidering the nature of injuries, Rs.35,000\/-<\/p>\n
  the Tribunal towards ‘pain and suffering’ is just<\/p>\n
and-proper and there is no scope for enhancement under this<\/p>\n

9. As Rs.11,200\/– awarded towards ‘medical<\/p>\n
expenses’ is based on medical bills produced by the clairnaizt,<\/p>\n
the same is just and proper and there is <\/p>\n
enhancement under this head.\n<\/p>\n
10. The claimant was treatedas lforbtwottdjays ” it<\/p>\n
on two spells. Considering the natpuredof iii’-juries ‘andduration
\nof treatment, Rs.2,000\/- awarded ribunal towards
\nincidental expenses as ‘clo}aveyalr:ce,’ nourishment and<\/p>\n
attendant charges’   there is no scope<\/p>\n
for enhancerln_’en–.’t ‘ :1. “l\n<\/p>\n
11. The   student and awarding
\ncoin.pensat\u00a7io’r1e\u00bbunder  head. ‘loss of income during laid up<\/p>\n
 the nature of injuries, disability as<\/p>\n
lstated   doctor and an amount of discomfort and<\/p>\n
$<\/p>\n
 the claimant has to undergo in his future life<\/p>\n
 awarded by the Tribunal towards ‘loss of<\/p>\n
amenities’ is just and proper and there is no scope for<\/p>\n
enhancement under this head.\n<\/p>\n
13. The claimant is aged about 19 years   .<\/p>\n
accident and he is a student of <\/p>\n
notional income is taken at Rs.l5,000′,’\/A–  <\/p>\n

 -L::1ssv.of..future income ~ Rs. 40,500<\/p>\n
 ATTOTAL \u00ab Rs.1, 13,700<\/p>\n
 Accordingly, the appeal is allowed in part. The<\/p>\n
., award passed by the Tribunal is modified to<\/p>\n
  ltheplextent stated herein above. The claimant is entitled for a<\/p>\n
W<\/p>\n
total compensation of Rs.1,13,’700\/– as against Rs.72,2_O0\/~<\/p>\n
awarded by the Tribunai with interest at 6% p.a.<\/p>\n
enhanced compensation of Rs.41,500\/– from the date  ”<\/p>\n
petition till the date of realisation.   <\/p>\n
16. The Insurance Company is to <\/p>\n
enhanced compensation arnoundt-.._\u00a7:t’;q*ith interest  ‘two
\nmonths from the date of receipt of<\/p>\n
17. Out of the enhanced 50% of the
\namount with propor’tidnjate  to be invested
\nin fixed deposit   in any Nationalised
\nBank\/Schedttledd period of 3 years with
