SEMA\n\nJUDGMENT:\n<\/pre>\n<p id=\"p_1\">J U D G M E N T<\/p>\n<p>ARIJIT PASAYAT, J.\n<\/p>\n<p id=\"p_1\">\tState of Maharashtra and the Punjabrao Krishi<br \/>\nVidyapeeth (hereinafter referred to as the &#8216;University&#8217;)<br \/>\nquestion legality of the judgment rendered by a Division<br \/>\nBench of the Bombay High Court, Nagpur Bench.  By the<br \/>\nimpugned judgment the High Court directed that there was no<br \/>\nnecessity for obtaining approval of the State Government for<br \/>\nthe purpose of treating the respondents (hereinafter<br \/>\nreferred to as the &#8217;employees&#8217;) as the permanent employees<br \/>\nw.e.f. 7.11.1983 and that they are entitled to all benefits<br \/>\nfrom that date as permanent employees.\n<\/p>\n<p id=\"p_2\">\tBackground facts in a nutshell are as follows:\n<\/p>\n<p id=\"p_3\">\tThe respondents and several others, who according to<br \/>\nthe appellants were engaged on seasonal basis, approached<br \/>\nthe Industrial Court, Maharashtra, Nagpur Bench, Nagpur by<br \/>\nfiling complaint purportedly under Section 28 read with Item<br \/>\n6 of Schedule IV of the Maharashtra Recognition of Trade<br \/>\nUnions and Prevention of Unfair Labour Practices Act, 1971<br \/>\n(hereinafter referred to as the &#8216;Act&#8217;). The case of the<br \/>\ncomplainants was that they were continuously working with<br \/>\nthe present appellant no.2-University in the College of<br \/>\nAgriculture, Nagpur without any break in service as daily-<br \/>\nwagers. The nature of duties performed by them is of<br \/>\npermanent nature. Even though they were being continued as<br \/>\ntemporary employees, they attended work of permanent nature.<br \/>\nAccording to them this practice was being followed to<br \/>\ndeprive them from getting benefits which a permanent workman<br \/>\nis entitled and this amounted to unfair labour practice<br \/>\nunder Item 6 of Schedule IV of the Act.  Prayer was made to<br \/>\nrestrain the University and the College from continuing with<br \/>\nthe unfair labour practice complained of and to make the<br \/>\ncomplainants permanent in the post they were working.  Stand<br \/>\nof the University and the College was that by itself it<br \/>\ncannot create permanent posts as the State Government has to<br \/>\nbe approached for this purpose.  It was pointed out that the<br \/>\nState Government was approached for making 140 labourers<br \/>\npermanent. The Industrial Court held that there was unfair<br \/>\nlabour practice and directed the respondents i.e. the<br \/>\nUniversity and the College to make the complainants<br \/>\npermanent subject to the approval of the State Government.<br \/>\nStand taken by the University was with reference to Section<br \/>\n50(B) of the Punjabrao Krishi University (Krishi Vidyapeeth)<br \/>\nAct, 1968 (in short the &#8216;<a href=\"\/doc\/890608\/\" id=\"a_1\">University Act<\/a>&#8216;). Six writ<br \/>\npetitions were filed by the University questioning<br \/>\ncorrectness of the judgment rendered by the Industrial<br \/>\nCourt. A learned Single Judge of the High Court of the<br \/>\nBombay High Court, Nagpur Bench in Writ Petition no.<br \/>\n143\/1983 along with writ petition nos. 170\/1983, 1171\/1982,<br \/>\n1172\/1982, 1173\/1982 and 1174\/1982 held that the order<br \/>\npassed in the complaint cases was to be modified to the<br \/>\nextent that for the words &#8220;subject to the approval of the<br \/>\nState Government&#8221; in each of the case the words &#8220;subject<br \/>\nto the prior approval of the State Government&#8221; were to be<br \/>\nsubstituted.\n<\/p>\n<p id=\"p_4\">\tThereafter, ten persons who are respondents herein<br \/>\nfiled a writ petition before the High Court to implement the<br \/>\norder of the Industrial Court. By the impugned judgment the<br \/>\nHigh Court held that the Industrial Court&#8217;s order was to be<br \/>\nmodified by excluding the words &#8220;subject to the approval of<br \/>\nthe State Government&#8221;. Accordingly, directed that all the<br \/>\nrespondents were to be treated as permanent employees with<br \/>\nall benefits w.e.f. 7.11.1983 i.e. the day on which <a href=\"\/doc\/890608\/\" id=\"a_1\">Section<br \/>\n50(B)<\/a> of the University Act was repealed by Maharashtra<br \/>\nAgricultural Universities (Krishi Vidyapeeth) Act, 1983 in<br \/>\n(short the &#8216;1983 Act&#8217;).  According to the High Court there<br \/>\nwas no provision similar to <a href=\"\/doc\/890608\/\" id=\"a_2\">Section 50(B)<\/a> of the Act in 1983<br \/>\nAct and, therefore, the question of any approval much less<br \/>\nprior approval of the State Government did not arise.\n<\/p>\n<p id=\"p_5\">\tLearned counsel for the appellants submitted that the<br \/>\norder dated 25th July, 1983 by which writ petition no.<br \/>\n143\/83 and other cases were disposed had attained finality.<br \/>\nMerely because the provision which was in operation when the<br \/>\norder of the Industrial Court was passed had subsequently<br \/>\nbeen repealed, same was really of no consequence.\n<\/p>\n<p id=\"p_6\">\tPer contra, learned counsel for the respondent<br \/>\nsubmitted that the direction of the High Court is in order<br \/>\nkeeping in view the fact that the University at all points<br \/>\nof time had taken the stand that it had a scheme for<br \/>\nregularization.\n<\/p>\n<p id=\"p_7\">\tIt is to be noted that the University as revealed from<br \/>\nthe affidavits filed before the High Court, had stated that<br \/>\nmore than 3,000 workers were engaged from time to time on<br \/>\ndaily-wages basis, besides 970 workers working on regular<br \/>\nbasis.  Whenever a post fell vacant or newly created with<br \/>\nthe approval of the competent authority and following due<br \/>\nprocedure the vacancies are filled up from amongst those who<br \/>\nare on daily-wages according to their zone-wise seniority<br \/>\nlist separately maintained for Nagpur and Amaravati zones.<br \/>\nThis position is not disputed by the respondents. That being<br \/>\nso, the order of the High Court is clearly untenable on more<br \/>\nthan one counts. Firstly, the order in writ petition no.<br \/>\n143\/83 and other connected cases dated 25th July, 1983 had<br \/>\nbecome final and there was no challenge to it.  Prayer in<br \/>\nthe subsequent writ petition to enforce Industrial Court&#8217;s<br \/>\nOrder is clearly not maintainable. Merely because <a href=\"\/doc\/890608\/\" id=\"a_3\">Section<br \/>\n50(B)<\/a> of the Act was repealed that did not take away the<br \/>\neffect of the order passed by the High Court in the earlier<br \/>\ncases.  The prayer for enforcement of the Industrial Court&#8217;s<br \/>\norder in its original form could not have been made, when<br \/>\nthe same had been modified by the High Court&#8217;s order which<br \/>\nhad attained finality.\n<\/p>\n<p id=\"p_8\">\tAdditionally, as observed by this Court in <a href=\"\/doc\/893566\/\" id=\"a_4\">Mahatma<br \/>\nPhule Agricultural University and Ors. v. Nazsik Zilla Sheth<br \/>\nKamgar Union and Ors<\/a>. (2001 (7) SCC 346) the status of<br \/>\npermanency cannot be granted when there is no post.  Again<br \/>\nin Ahmednagar Zilla Shetmajoor Union v. Dinkar Rao Kalyanrao<br \/>\nJagdale (2001 (7) SCC 356), it was held that mere<br \/>\ncontinuance every year of seasonal work obviously during the<br \/>\nperiod when the work was available does not constitute a<br \/>\npermanent status unless there exists posts and<br \/>\nregularization is done.\n<\/p>\n<p id=\"p_9\">\tAbove being the position the impugned judgment of the<br \/>\nHigh Court cannot be maintained and is set aside.  It is,<br \/>\nhowever, not in dispute that except respondent no.8 who has<br \/>\ndied in the meantime the others have been at points of time<br \/>\nregularized.  The regularization shall take effect from the<br \/>\nrespective dates of order in that regard as passed by the<br \/>\nauthority and not from 7.11.1983 as directed by the High<br \/>\nCourt.\n<\/p>\n<p id=\"p_10\">\tThe appeal is allowed to the aforesaid extent without<br \/>\nany order as to costs.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Supreme Court of India State Of Maharashtra And Anr vs R.S.
