This petition is filed under <a href=\"\/doc\/1331149\/\" id=\"a_1\">Article 227<\/a> of<\/p>\n<p>Constitution of India for a direction to Sub Court, Mavelikkara to<\/p>\n<p>refer the suit to District Lok Adalath and to dispose the matter<\/p>\n<p>by settlement.\n<\/p>\n<p id=\"p_1\">      Learned counsel appearing for petitioner submitted that<\/p>\n<p>petitioner filed WP(C) 11346 of 2008, when respondent Bank<\/p>\n<p>proceeded under Securitisation and Reconstruction of Financial<\/p>\n<p>Assets and <a href=\"\/doc\/198257891\/\" id=\"a_1\">Enforcement of Security Act<\/a>, 2002 and as per Ext.P2<\/p>\n<p>judgment, petitioner was directed by this court to pay the entire<\/p>\n<p>amount in six equal monthly instalments and petitioner paid the<\/p>\n<p>amount as directed and is willing to pay the balance amount also<\/p>\n<p>and therefore the case could be settled if referred to the Adalath.<\/p>\n<p id=\"p_2\">      2. Learned counsel appearing for respondent submitted<\/p>\n<p>that Lok Adalath has considered this matter earlier as is seen<\/p>\n<p>from Ext.P6 reply, and the matter could not be settled and<\/p>\n<p>therefore the case need not be referred to the Adalath.<\/p>\n<p id=\"p_3\">      3. It is not for this court to decide whether the suit is to be<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">WP(C) 25213\/2008                2<\/span><\/p>\n<p>referred to the Adalath or not. It is for the learned Sub Judge to<\/p>\n<p>decide whether there is a chance of settlement and if so, refer<\/p>\n<p>the suit to Adalath.
