PRAKASH TATIA, J.\n<\/pre>\n<p>Mr.M.D. Boob,for the appellants.\n<\/p>\n<p>Mr.J.P. Chhangani, for the respondent.\n<\/p>\n<p>     Heard learned counsel for the parties.<\/p>\n<p>     According to the learned counsel for the appellant, the<\/p>\n<p>appellant-plaintiffs   themselves   gave   the    property      in<\/p>\n<p>question to the respondent-defendant and that too, for the<\/p>\n<p>purpose of putting on the building materials which can be<\/p>\n<p>used only for giving on rent basis to the others and there<\/p>\n<p>was earlier round of litigation wherein in second appeal, this<\/p>\n<p>Court has already passed the order that the appellant shall<\/p>\n<p>not dispossess the respondent-defendant without following<\/p>\n<p>due process of law.\n<\/p>\n<p>     The appellant contends that the licencee has no right<\/p>\n<p>in the property and Hon&#8217;ble Apex Court held that even<br \/>\n                                                    SBCMA No.146\/08<br \/>\n                                        Sohan Lal &amp; Anr. Vs. Bansi Lal<\/p>\n<p><span class=\"hidden_text\">                               2<\/span><\/p>\n<p>force can be used to remove the licensee by the licenser. It<\/p>\n<p>is also submitted that this Court in the case of Smt.<\/p>\n<p>Shakuntala Vs. Union of India &amp; Ors, after considering 27<\/p>\n<p>judgments of Hon&#8217;ble Apex Court and few judgments of this<\/p>\n<p>Court held that licence does not create any right in the<\/p>\n<p>property in favour of the grantee.\n<\/p>\n<p>     In view of the above reason, the appellant is entitled<\/p>\n<p>to seek immediate possession by way of interim mandatory<\/p>\n<p>injunction restraining the defendant from doing the business<\/p>\n<p>of the building material from the plot in question and also<\/p>\n<p>take possession with the help of the Court&#8217;s order that may<\/p>\n<p>be of interim nature.\n<\/p>\n<p>     I have considered the submissions of the learned<\/p>\n<p>counsel for the appellant and perused the facts of the case.<\/p>\n<p>     The appellants&#8217; own case is that there is order passed<\/p>\n<p>in the second appeal between the parties for this very<\/p>\n<p>property   that   the   appellant   shall   not   be entitled      to<\/p>\n<p>dispossess the defendant without following due process of<\/p>\n<p>law, then by adopting another mode, the appellant cannot<\/p>\n<p>seek possession from the respondent-defendant and the<br \/>\n                                                 SBCMA No.146\/08<br \/>\n                                     Sohan Lal &amp; Anr. Bansi Lal<\/p>\n<p><span class=\"hidden_text\">                             3<\/span><\/p>\n<p>appellant can take possession of the property in dispute<\/p>\n<p>only by following due process of law. The appellant could<\/p>\n<p>not explain how the order passed in second appeal can be<\/p>\n<p>nullified in this way by obtaining the interim mandatory<\/p>\n<p>injunction for the property on the ground that in residential<\/p>\n<p>area, there cannot be commercial activities, which is going<\/p>\n<p>on because of the reason that according to the appellant<\/p>\n<p>himself, the property was given to the defendant for putting<\/p>\n<p>on the building material which can be used for giving on<\/p>\n<p>hire only. The appellants are also seeking interim relief<\/p>\n<p>which can be granted in the suit and in the present facts<\/p>\n<p>and circumstances of the case, granting relief to the<\/p>\n<p>appellant would amount to decreeing the suit itself without<\/p>\n<p>giving opportunity to the respondent-defendant, that too<\/p>\n<p>when the second appeal is pending in this Court with<\/p>\n<p>respect to the claims of the parties involving the same<\/p>\n<p>property.\n<\/p>\n<p>     In view of the above reason, and particularly the<\/p>\n<p>binding order which has not been challenged by the<\/p>\n<p>appellants passed in second appeal that the appellant shall<br \/>\n                                                          SBCMA No.146\/08<br \/>\n                                              Sohan Lal &amp; Anr.
