SURENDRA MOHAN, JJ.\n             -------------------------------------------------\n                  O.P.(FC) No.1234 of 2010-R\n             -------------------------------------------------\n         Dated this the 21st day of December, 2010\n\n                             JUDGMENT\n<\/pre>\n<p id=\"p_1\">Basant,J.\n<\/p>\n<p id=\"p_1\">\n<p id=\"p_2\">     The petitioner herein is the defendant in a suit filed by the<\/p>\n<p>respondent, his wife, for partition and separate possession of her<\/p>\n<p>half rights in an item of property.       Acquisition is admittedly in<\/p>\n<p>the joint names of the parties.       The petitioner\/husband has set<\/p>\n<p>up a contention that the property belongs to him exclusively.<\/p>\n<p>The Original Petition was filed as early as in 2003. The evidence<\/p>\n<p>is over. The matter is at the stage of arguments. At this stage,<\/p>\n<p>the petitioner filed a petition for production of documents.       As<\/p>\n<p>per Exts.P1 and P2, thirteen documents have been produced. It<\/p>\n<p>is submitted that the documents have already been received.<\/p>\n<p>The petitioner filed an application to recall the respondent, his<\/p>\n<p>wife, for cross-examination for the sole purpose of confronting<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">O.P.(FC) No.1234 of 2010 -: 2 :-<\/span><\/p>\n<p>her with the documents referred to in Exts.P1 and P2. By the<\/p>\n<p>impugned order, the court below rejected the said prayer. The<\/p>\n<p>petitioner claims to be aggrieved by the impugned order.<\/p>\n<p id=\"p_3\">      2. A perusal of the sequence of events in this case does not<\/p>\n<p>at all reveal any bona fides on the part of the petitioner. But all<\/p>\n<p>the same, we are satisfied that true to the adage that a stitch in<\/p>\n<p>time save&#8217;s nine it would be advantageous to give the petitioner<\/p>\n<p>an opportunity to cross-examine the respondent with specific<\/p>\n<p>reference to the 13 documents referred to in Exts.P1 and P2.<\/p>\n<p>Such luxury of a further opportunity can, of course, be granted<\/p>\n<p>only subject to very strict conditions taking note of the fact that<\/p>\n<p>the proceedings has been pending from 2003 and the matter<\/p>\n<p>had at long last reached the stage of arguments.<\/p>\n<p id=\"p_4\">      3. In the nature of the order that we propose to pass, we<\/p>\n<p>are satisfied that it is not necessary to wait for issue and return<\/p>\n<p>of notice to the respondent.        The learned counsel for the<\/p>\n<p>petitioner asserts that the respondent is available in India and<\/p>\n<p>will be readily available for cross-examination if opportunity is<\/p>\n<p>granted.\n<\/p>\n<p id=\"p_5\">      4. In the result:\n<\/p>\n<p id=\"p_6\">      (a) This writ petition is allowed subject to conditions.<\/p>\n<p id=\"p_7\">      (b) The case before the Family Court stands posted to this<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">O.P.(FC) No.1234 of 2010 -: 3 :-<\/span><\/p>\n<p>date, it is submitted.     Before the next date of posting, the<\/p>\n<p>petitioner shall deposit cost of Rs.7,500\/- in which event an<\/p>\n<p>opportunity for cross-examination of the respondent shall be<\/p>\n<p>granted to the petitioner herein. If such deposit is made, the<\/p>\n<p>respondent shall be made available for cross-examination for<\/p>\n<p>one day and on that day the petitioner shall proceed with the<\/p>\n<p>cross-examination of the respondent.<\/p>\n<p id=\"p_8\">      5. The Family Court shall report to this Court whether the<\/p>\n<p>directions have been complied with.
