JUSTICE JYOTI SARAN\n                     ORAL ORDER<\/pre>\n<p id=\"p_1\">                     (Per: HONOURABLE THE CHIEF JUSTICE)<\/p>\n<p id=\"p_1\">07.   29.11.2010                 This appeal preferred under Clause 10 of the<\/p>\n<p>                   Letters Patent arises from the judgment and order dated 18th<\/p>\n<p>                   March 2010 passed by the learned Single Judge in above<\/p>\n<p>                   C.W.J.C. No. 4682 of 2009. Under the impugned judgment and<\/p>\n<p>                   order the learned Single Judge has directed the appellant State of<\/p>\n<p>                   Bihar to vacate the disputed property utilized for residence of<\/p>\n<p>                   Sub-Divisional Officer, Khagaria.\n<\/p>\n<p id=\"p_2\">                                 The respondent no. 1-writ petitioner filed above<\/p>\n<p>                   C.W.J.C. No. 4682 of 2009 for recovery of possession of the<\/p>\n<p>                   disputed property. According to the petitioner, he was the owner<\/p>\n<p>                   of the property and that the appellant-State of Bihar was the<\/p>\n<p>                   tenant. The petition was contested, inter alia, on the ground that<\/p>\n<p>                   if the appellant-State were the tenant the writ petition for<\/p>\n<p>                   recovery of possession was not maintainable. The remedy lay<br \/>\n<span class=\"hidden_text\" id=\"span_1\">                       2<\/span><\/p>\n<p>under the <a href=\"\/doc\/679372\/\" id=\"a_1\">Rent Act<\/a>.\n<\/p>\n<p id=\"p_3\">              One Sanjeev Kumar Tulsyan, appellant in Letters<\/p>\n<p>Patent Appeal No. 988 of 2010, intervened in the writ petition.<\/p>\n<p>According to the said intervener, he wanted to assist the court,<\/p>\n<p>and that the Court should not accept the title claimed by the writ<\/p>\n<p>petitioner. The learned single judge rejected the intervention as<\/p>\n<p>misconceived.\n<\/p>\n<p id=\"p_4\">              The learned Single Judge upheld the claim of the<\/p>\n<p>petitioner and directed the appellant-State of Bihar to ensure that<\/p>\n<p>within a reasonable time the premises in question should be<\/p>\n<p>vacated and that the State handed over the property to the<\/p>\n<p>petitioner. The learned Single Judge also clarified that nothing<\/p>\n<p>stated in the judgment would confer exclusive title on the<\/p>\n<p>petitioner against the other co-sharers.\n<\/p>\n<p id=\"p_5\">              After couple of hearings before this Court, one Sri<\/p>\n<p>Sushil Kumar, Sub-Divisional Officer, Khagaria has filed<\/p>\n<p>supplementary affidavit.    As per the statements made in the<\/p>\n<p>supplementary affidavit, the State shall, without prejudice to its<\/p>\n<p>rights and contentions, vacate the disputed property within one<\/p>\n<p>year. It is further stated that the appellant-State does not accept<\/p>\n<p>the title of the respondent no. 1 nor does it accept that it is a<\/p>\n<p>tenant in the disputed property.\n<\/p>\n<p id=\"p_6\">              In view of the aforesaid statements made in the<\/p>\n<p>supplementary affidavit, without prejudice to the rights and<\/p>\n<p>contentions raised by the appellant-State Government, We direct<br \/>\n<span class=\"hidden_text\" id=\"span_1\">                                3<\/span><\/p>\n<p>         that the appellant-State Government will vacate the disputed<\/p>\n<p>         property on or before 31st December 2011.           Until the State<\/p>\n<p>         Government hands over the vacant possession of the disputed<\/p>\n<p>         property to the petitioner, the State Government will deposit<\/p>\n<p>         occupancy fee of Rs.      5,000\/- every month with the House<\/p>\n<p>         Controller, Khagaria. Such deposit will be made by 10th day of<\/p>\n<p>         every month, commencing from January, 2011. The amount of<\/p>\n<p>         occupancy fee deposited by the appellant-State Government will<\/p>\n<p>         be remitted to the petitioner within 15 days of the deposit.<\/p>\n<p id=\"p_7\">                       The above order is not intended to confer title<\/p>\n<p>         upon the petitioner or does not accept the exclusive right of the<\/p>\n<p>         petitioner to the disputed property or the amount of occupancy<\/p>\n<p>         fee. If a third party has a claim to the title to the disputed<\/p>\n<p>         property or any part of it or to receive the amount of occupancy<\/p>\n<p>         fee or any part of it; such claim may be decided in accordance<\/p>\n<p>         with law without being influenced by this order.<\/p>\n<p id=\"p_8\">                       Subject to the above direction, the Letters Patent<\/p>\n<p>         Appeal is disposed of. It is clarified that the impugned judgment<\/p>\n<p>         and order passed by the learned Single Judge will not be treated<\/p>\n<p>         as a precedent in similar matters.\n<\/p>\n<p id=\"p_9\">\n<p id=\"p_10\">                                         (R.M.
