2. 15.10.2011. Heard learned counsels for the<\/p>\n

petitioner and the State.\n<\/p>\n

The petitioner is apprehending his<\/p>\n

arrest in a case registered under Sections<\/p>\n

307<\/a>, 379<\/a>\/34<\/a> of the Indian Penal Code and<\/p>\n

Section 27<\/a> of the Arms Act.\n<\/p>\n

The specific accusation of firing is<\/p>\n

against Vinay Paswan who is not petitioner<\/p>\n

before this Court while the accusation<\/p>\n

against the petitioner and others is of<\/p>\n

taking Rs. 40,000\/- from pocket of the<\/p>\n

informant.\n<\/p>\n

It is submitted by learned counsel<\/p>\n

for the petitioner that similarly situated<\/p>\n

accused person, namely, Sanjay Paswan has<\/p>\n

already been granted anticipatory bail by<\/p>\n

this Court vide Cr. Misc. No. 43714 of 2010.<\/p>\n

Considering the aforesaid facts, let<\/p>\n

the petitioner, above named, be released on<\/p>\n

bail in the event of arrest or surrender<\/p>\n

before the learned court below within a<\/p>\n

period of twelve weeks from today in<\/p>\n

connection with Tandwa P.S. Case No. 23 of
\n 2<\/span><\/p>\n

2010 on furnishing bail bond of Rs.10,000\/-<\/p>\n

(Ten Thousand) with two sureties of the like<\/p>\n

amount each to the satisfaction of the<\/p>\n

learned C.J.M. Aurangabad(Bihar), subject to<\/p>\n

the conditions as laid down under Section<\/p>\n

438(2)<\/a> of the Code of Criminal Procedure.<\/p>\n
