RAMACHANDRAN NAIR, J.\n              ---------------------------------------\n                  W.P.(C) No.21294 OF 2010\n              ---------------------------------------\n            Dated this the 20th day of July, 2010.\n\n\n                         J U D G M E N T\n<\/pre>\n<p id=\"p_1\">     Essentially the matter concerns the prayer for a direction to<\/p>\n<p>the 1st respondent to refer the matter to the Land Acquisition<\/p>\n<p>court. Herein, the petitioner was the owner and in possession of<\/p>\n<p>the property having an extent of 1 Acre and 53 cents in resurvey<\/p>\n<p>No.63\/03B of Keezhalloor village, Thalassery Taluk. The property<\/p>\n<p>was   acquired   by   the   Kerala   Infrastructure  Development<\/p>\n<p>Corporation (KINFRA) for the Kannur Airport Project.          The<\/p>\n<p>valuation as well as other steps for payment of compensation<\/p>\n<p>were completed by negotiation with the 2nd respondent.<\/p>\n<p id=\"p_1\">     2. The dispute herein is with respect to the 8 cents of land<\/p>\n<p>for which the Keezhalloor Panchayath has also claimed ownership<\/p>\n<p>and possession. Ultimately, the petitioner filed a statement as<\/p>\n<p>per Exhibit P2 claiming compensation for the land at the rate of<\/p>\n<p>Rs.1 lakh per cent. The petitioner has also sought for reference<\/p>\n<p>of the matter to the reference court. This is answered by the<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">W.P.(C) No.21294\/2010               2<\/span><\/p>\n<p>Land Acquisition Officer by Exhibit P3 stating that the petitioner<\/p>\n<p>had confined the claim for compensation only to the extent of 1<\/p>\n<p>Acre and 45 cents and presently, Keezhalloor Grama Panchayath<\/p>\n<p>is in possession of the property.\n<\/p>\n<p id=\"p_2\">       3. Learned counsel for the petitioner submitted that it is<\/p>\n<p>entirely a matter for the reference court to decide and it was not<\/p>\n<p>open for the Special Tahsildar to consider the disputed claims<\/p>\n<p>between the parties. Evidently, the application for reference is<\/p>\n<p>under <a href=\"\/doc\/1517117\/\" id=\"a_1\">Section 18<\/a> of the Land Acquisition Act, 1894.<\/p>\n<p id=\"p_3\">       In that view of the matter, there will be a direction to the<\/p>\n<p>1st respondent to refer the claim for compensation to the<\/p>\n<p>reference court in terms of <a href=\"\/doc\/1517117\/\" id=\"a_1\">Section 18<\/a> of the Land Acquisition Act<\/p>\n<p>if the application is filed within the statutory period prescribed.<\/p>\n<p>Appropriate action will be taken within a period of one month<\/p>\n<p>from the date of receipt of a copy of this judgment.           The<\/p>\n<p>petitioner will produce a copy of this judgment along with a copy<\/p>\n<p>of the writ petition for compliance.\n<\/p>\n<p id=\"p_4\">       This writ petition is disposed of as above.\n<\/p>\n<p id=\"p_5\">\n<p id=\"p_6\">                                   T.R.
