I &#8211; 38 of 2010 dated 25.07.2010 registered with the<br \/>\n\tBhavnagar Mahila Police Station has approached this Court, invoking<br \/>\n\t<a href=\"\/doc\/1679850\/\" id=\"a_1\">Section 482<\/a> of the CrPC for seeking quashment of the complaint qua<br \/>\n\tpresent petitioner, on the ground that the allegation even on the<br \/>\n\tface of it, if considered to be correct then also, no offence is<br \/>\n\tdisclosed.\n<\/p>\n<p id=\"p_1\">This<br \/>\n\tCourt (Coram: Mr.M.D.Shah, J.) on 31.03.2011 passed following<br \/>\n\torder:-\n<\/p>\n<p id=\"p_2\">&#8220;RULE<br \/>\nreturnable qua respondent No.2 on 25\/04\/2011.  Ms.C M Shah, learned<br \/>\nAPP waives service of notice on behalf of respondent No.1.  Direct<br \/>\nService is permitted.&#8221;\n<\/p>\n<p id=\"p_3\">The<br \/>\n\tBoard indicate that all concerned are served. Original complainant<br \/>\n\tis served by way of direct service. Learned advocate for the<br \/>\n\tpetitioner has submitted at the bar that the direct service is<br \/>\n\teffected to the original complainant and looking to the entire<br \/>\n\tcontroversy, the matter was taken-up for final disposal.\n<\/p>\n<p id=\"p_4\">Respondent<br \/>\n\tNo.2 lodged the complaint in the form of FIR being CR No.I &#8211;<br \/>\n\t38 of 2010 on 25.07.2010 registered with the Bhavnagar Mahila Police<br \/>\n\tStation for the offences punishable under <a href=\"\/doc\/445276\/\" id=\"a_1\">Sections 498(A)<\/a>, <a href=\"\/doc\/445276\/\" id=\"a_2\">504<\/a>,<br \/>\n\t<a href=\"\/doc\/445276\/\" id=\"a_3\">506(2)<\/a>, <a href=\"\/doc\/445276\/\" id=\"a_4\">497<\/a>, <a href=\"\/doc\/770961\/\" id=\"a_5\">323<\/a> and <a href=\"\/doc\/989759\/\" id=\"a_6\">114<\/a> and under <a href=\"\/doc\/751411\/\" id=\"a_7\">Sections 3<\/a>, <a href=\"\/doc\/209280\/\" id=\"a_8\">7<\/a> and <a href=\"\/doc\/88472\/\" id=\"a_9\">10<\/a> of the Dowry<br \/>\n\tProhibition Act, 1961. The present petitioner is alleged to have<br \/>\n\tintimate relationship with the husband of the complainant and<br \/>\n\tpresent petitioner happens to be unmarried lady having no<br \/>\n\trelationship either with the accused or with the family of the<br \/>\n\taccused, which fall in the purview of the <a href=\"\/doc\/1868826\/\" id=\"a_10\">Section 498<\/a> of the Indian<br \/>\n\tPenal Code. The allegation mentioned in the memo of the complainant<br \/>\n\tdid not disclose any overt act. Learned advocate for the petitioner<br \/>\n\tstates that the husband and in-laws of the complainant are thus a<br \/>\n\tparty of the committing crime. This, in my view, would not be<br \/>\n\tsufficient to saddle the<br \/>\n\tpresent petitioner with rigors of the criminal proceedings. The<br \/>\n\tcomplaint, on the face of it, more or less under <a href=\"\/doc\/1833006\/\" id=\"a_11\">Sections 497<\/a> and<br \/>\n\t<a href=\"\/doc\/1868826\/\" id=\"a_12\">498(A)<\/a> of Indian Penal Code or other provision, which is sought to<br \/>\n\tbe invoked, has to lay upon the averments made in the complaint. In<br \/>\n\tthe instant case, the perusal of the complaint does not suggest any<br \/>\n\tovert act so as to rope in the petitioner for the offence as<br \/>\n\talleged. Therefore, present complaint is quashed, qua present<br \/>\n\tpetitioner only.\n<\/p>\n<p id=\"p_5\">At<br \/>\n\tthis stage, it is required to be noted that in Criminal<br \/>\n\tMiscellaneous Application No.13244 of 2010, on 20.12.2010, this<br \/>\n\tCourt (Coram: Mr.M.R.Shah, J.) has quashed the complaint, qua<br \/>\n\taccused Nos.3 to 5 of the complainant viz. Nileshbhai Bhimjibhai<br \/>\n\tKalani, Nehal Kalani and Nipulbhai Bhimjibhai Kalani. Learned<br \/>\n\tadvocate for the petitioner stated at the bar at that time of that<br \/>\n\tpetition, present petitioner was not the applicant, therein.\n<\/p>\n<p id=\"p_6\">\tRule<br \/>\nis made absolute.
