Justice A.K.BASHEER\n\n Dated :13\/09\/2007\n\n O R D E R\n       K.S.RADHAKRISHNAN &amp; A.K.BASHEER, JJ\n                        -------------------\n       W.P.(C).Nos. 4731\/07, 26320\/07 &amp; W.A.2199\/07\n                        --------------------\n        Dated this the 13th day of September, 2007\n\n                        JUDGMENT\n<\/pre>\n<p id=\"p_1\">Radhakrishnan, J<\/p>\n<p>           Writ Appeal 2199\/2007 is preferred against the<\/p>\n<p>judgment in W.P.(C).24932\/2007 directing the concerned<\/p>\n<p>authorities to     take steps to include the      petitioners<\/p>\n<p>therein in the list of approved probationers based on their<\/p>\n<p>seniority. Appellants herein, included in the seniority list<\/p>\n<p>of approved probationers, claim that they are eligible for<\/p>\n<p>promotion as Tahsildars        earlier than the respondents.<\/p>\n<p>According to the appellants the writ petitioners cannot<\/p>\n<p>have a march over them.\n<\/p>\n<p id=\"p_1\">      2.   Commissioner, Land Revenue, has reported that<\/p>\n<p>the Departmental Promotion Committee was convened on<\/p>\n<p>5.9.2007. Petitioners&#8217; names were also considered by that<\/p>\n<p>Committee and the process for publication of the select<\/p>\n<p>list is now in progress.    The names of petitioners in W.P.<\/p>\n<p>(C).24932\/2007 were not considered by the Committee<\/p>\n<p>since the collection of details in respect of those officials<\/p>\n<p>from the District Collector&#8217;s could not be completed. It is<\/p>\n<p>also submitted that there is no move to place the<\/p>\n<p>W.P.(C)s.26230\/07, 4731\/07 &amp;<br \/>\n<span class=\"hidden_text\" id=\"span_1\">W.A.2199\/07                    2<\/span><\/p>\n<p>petitioners in W.P.(C).24932\/2007 as seniors and to rank<\/p>\n<p>them above the appellants<\/p>\n<p id=\"p_2\">      3.    Appellants      in W.A.2199\/2007      are    the<\/p>\n<p>petitioners in W.P.(C).4731\/2007, which          has been<\/p>\n<p>preferred seeking a writ of certiorari to quash Ext.P5<\/p>\n<p>select list of Deputy Tahsildars for promotion as<\/p>\n<p>Tahsildars and also for a writ of mandamus directing the<\/p>\n<p>respondent to revise the seniority lists of H.C\/R.I and<\/p>\n<p>Deputy Tahsildars on the basis of the revised seniority<\/p>\n<p>list of <a href=\"\/doc\/41668332\/\" id=\"a_1\">U.D.C\/V.O<\/a>.s to be finalized as directed in Ext.P4<\/p>\n<p>order    and     also    for other consequential     reliefs.<\/p>\n<p>According to the petitioners,     the select list is issued<\/p>\n<p>without waiting for the revised seniority list and if the<\/p>\n<p>select list is prepared after the revised seniority list is<\/p>\n<p>issued, they will also find a place in the select list. The<\/p>\n<p>petitioners in W.P.(C).24932\/2007 were not considered<\/p>\n<p>for promotion by the departmental promotion committee.<\/p>\n<p id=\"p_3\">      4.    Writ Petition 26320\/2007 was preferred<\/p>\n<p>seeking a writ of mandamus directing the second<\/p>\n<p>respondent to include the name of the petitioner in the<\/p>\n<p>list of approved probationers of Deputy Tahsildars and<\/p>\n<p>W.P.(C)s.26230\/07, 4731\/07 &amp;<br \/>\n<span class=\"hidden_text\" id=\"span_1\">W.A.2199\/07                    3<\/span><\/p>\n<p>consider the petitioner      for promotion to the post of<\/p>\n<p>Tahsildar while considering the case of the petitioners<\/p>\n<p>in Ext.P11 judgment in accordance with his seniority.<\/p>\n<p id=\"p_4\">     5.     We find it unnecessary to interfere in these<\/p>\n<p>matters     at    present.
