JUSTICE ABHILASHA KUMARI\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 18\/01\/2011  \n \nCOMMON ORAL ORDER<\/pre>\n<p id=\"p_1\">1.\tThis<br \/>\npetition is to be tagged with Special Civil Application Nos. 438 to<br \/>\n454 of 2011.\n<\/p>\n<p id=\"p_1\">2.\tHeard<br \/>\nMr. Paresh Upadhyay, learned advocate for the petitioners. The<br \/>\nsubmissions made by him are that :-\n<\/p>\n<p id=\"p_2\">(A)\tThe<br \/>\npetitioners are Gram Rojgar Sevaks who have been working since 2008<br \/>\nand have experience of the work they are doing. The State Government,<br \/>\nby a Government Resolution dated 15.09.2010, has decided, as a matter<br \/>\nof policy, to increase the salary of the sanctioned posts shown in<br \/>\nthe schedule attached to the resolution and to continue the<br \/>\nsanctioned posts upto 28.02.2014, and also to give 15% increase in<br \/>\nthe salary every year to those who are working.\n<\/p>\n<p id=\"p_3\">(B)\tDespite<br \/>\nclear stipulations of the State Government in the said Government<br \/>\nResolution, respondent No.3 has misinterpreted the resolution and has<br \/>\nadvertised all 13,715 posts of Gram Rojgar Sevak including the posts<br \/>\non which persons like the petitioners are already working. Further,<br \/>\nby issuing corrigendum dated 04.01.2011, it is declared that the<br \/>\nmerit list on the basis of the marks secured in the HSC examination<br \/>\nwill be prepared and the hall tickets for appearing in the<br \/>\nexamination will be issued on that basis. It is further stipulated in<br \/>\nthe said corrigendum that the candidates who are not selected for<br \/>\nappearing in the on-line examination to be held from 18.01.2011 to<br \/>\n21.01.2011 will be refunded the amount paid by them for the hall<br \/>\ntickets. However, the said corrigendum is silent as to the criteria<br \/>\non which the respondents propose to select the candidates for<br \/>\nappearance in the on-line examination.\n<\/p>\n<p id=\"p_4\">(C)\tExcept<br \/>\none petitioner, all other petitioners have been issued hall tickets<br \/>\nfor appearance in the on-line examination on their payment of<br \/>\nRs.100\/- each. Therefore, without prejudice to their rights and<br \/>\ncontentions as taken in the petition, or as may be taken during the<br \/>\ncourse of hearing of the petition, the petitioners shall participate<br \/>\nin the said examination, if they are permitted to do so.\n<\/p>\n<p id=\"p_5\">3.\tMr. Maulik G. Nanavati, learned<br \/>\nAssistant Government Pleader states, upon instructions of Mr. H.N.<br \/>\nChibber, Additional Commissioner, Rural Development who is present in<br \/>\nthe Court, that  without prejudice to the rights and contentions of<br \/>\nthe State Government, those petitioners who are working on<br \/>\ncontractual basis and who have not been issued hall tickets for<br \/>\nappearance in the on-line examination, shall be given hall tickets on<br \/>\npayment of an additional amount of Rs.300\/- each. Upon making the<br \/>\nsaid payment, they shall be permitted to appear in the on-line<br \/>\nexamination subject to their educational qualifications, meeting the<br \/>\neligibility criteria and their possessing the minimum educational<br \/>\nqualification of HSC Certificate. The date and venue of the<br \/>\nexamination shall be intimated to the petitioners by 19.1.2011.\n<\/p>\n<p id=\"p_6\">4.\tAt this stage, the learned advocate<br \/>\nfor the petitioners states that the advertisement mentions that the<br \/>\namount of Rs.100\/- is to be paid for obtaining hall tickets, whereas<br \/>\nnow, since the petitioners have approached this Court, the<br \/>\nrespondents are demanding Rs.300\/- more from each of them. It is<br \/>\nsubmitted that the petitioners shall deposit the excess amount,<br \/>\nwithout prejudice to the rights and contentions, subject to further<br \/>\norders of the Court in this regard at an appropriate stage.\n<\/p>\n<p id=\"p_7\">5.\tIn view of the above and in keeping<br \/>\nwith the statement made by the learned AGP, on instructions from Mr.<br \/>\nH.N. Chibber, Additional Commissioner, Rural Development, those<br \/>\npetitioners who have not been given hall tickets shall be given hall<br \/>\ntickets on payment of Rs.300\/- each before the same authority, where<br \/>\nthe amount of Rs.100\/- has been deposited by them, subject to further<br \/>\norders in this regard.\n<\/p>\n<p id=\"p_8\">6.\tNOTICE<br \/>\nreturnable on 01.02.2011. Mr. Maulik G. Nanavati, learned Assistant<br \/>\nGovernment Pleader waives service of notice for respondent Nos.1 and\n<\/p>\n<p id=\"p_9\">2.
