02\/-   15\/07\/2011                     Heard learned counsel for the petitioner and learned<\/p>\n
                        Additional Public Prosecutor for the State.\n<\/p>\n
                                      In this case petitioner’s         name emerged         during<\/p>\n
                        investigation, whereas the two named accused having direct<\/p>\n
                        allegations have already been granted the privilege by a Bench of this<\/p>\n
                        Court, vide order dated 22.12.2009 passed in Cr. Misc. No. 38012 of<\/p>\n
                        2009.\n<\/p>\n
                                      Considering the facts and circumstances of the case, in<\/p>\n
                        the event of his arrest\/surrender before the court below within four<\/p>\n
                        weeks, let the petitioner, namely, Deepak Kumar, be enlarged on bail<\/p>\n
                        on furnishing bail bond of Rs. 10,000\/- (ten thousand only) with two<\/p>\n
                        sureties of the like amount each to the satisfaction of Chief Judicial<\/p>\n
                        Magistrate, Nawadah, in connection with Hisua P.S. Case No. 65 of<\/p>\n
                        2009, subject to condition laid down under Section 438 (2) of the<\/p>\n
                        Criminal Procedure Code<\/a> with additional condition to remain<\/p>\n
                        physically present before the court below on each and every date at<\/p>\n
                        least for three years or till disposal of the case, whichever is earlier, in<\/p>\n
                        case of failure on two consecutive dates, without giving any<\/p>\n
                        reasonable explanation, the liberty granted shall be deemed to be<\/p>\n
                        cancelled.\n<\/p>\n
