JUSTICE D.K.SINHA\n\n\n         For the Petitioners:          Mr. Purnendu Kumar Jha, Advocate.\n         For the State:                A.P.P.\n         For the O.P.No.2:             Mr. P.K.Chaudhary, Advocate.\n                              -------------\n06\/ 11.07.2011<\/pre>\n<p id=\"p_1\">           The petitioners have invoked the inherent power of this Court<br \/>\n         under <a href=\"\/doc\/1679850\/\" id=\"a_1\">Section 482<\/a> of the Code of Criminal Procedure for the quashment of<br \/>\n         the order dated 07.12.2009 passed by the C.J.M., Incharge, Godda in<br \/>\n         G.R.No.1002 of 2009 arising out of Godda (Town) P.S. Case No.295 of 2009<br \/>\n         corresponding to T.R.No.1469 of 2009 by which the cognizance of the offence<br \/>\n         was taken under <a href=\"\/doc\/538436\/\" id=\"a_1\">Section 498A<\/a>\/<a href=\"\/doc\/37788\/\" id=\"a_2\">34<\/a> of the Indian Penal Code as also under<br \/>\n         Section \u00be of the <a href=\"\/doc\/1763444\/\" id=\"a_3\">Dowry Prohibition Act<\/a> and also for the quashment of the<br \/>\n         entire F.I.R.\n<\/p>\n<p id=\"p_1\">         2.              A written report was presented before Godda Police by the<br \/>\n         complainant-Opposite Party No.2-Sangita Devi admitting that she had<br \/>\n         escaped with her paramour Bullu @ Aditya Gupta in the month of October,<br \/>\n         2008 and having been aggrieved by that act, her father Nand Kishore Sah<br \/>\n         had instituted a police case against Bullu @ Aditya Gupta and the members<br \/>\n         of his family. The informant further admitted that she was earlier married to<br \/>\n         one Pankaj Mandal at village Sarwa and she was having a daughter from her<br \/>\n         earlier marriage with Pankaj Mandal but on account of torture being<br \/>\n         perpetrated by Pankaj Mandal he had socially severed her relationship with<br \/>\n         him and began to live with her parents at Lohia Nagar Godda. During her stay<br \/>\n         in the parental home, it was alleged that the accused Bullu @ Aditya Gupta<br \/>\n         proposed to marry her on account of love that he developed with her and he<br \/>\n         further allured that she would be accepted with her daughter to which she had<br \/>\n         communicated his proposal to her parents indirectly to which they did not<br \/>\n         express their agreement and finding no way out she escaped with Bullu @<br \/>\n         Aditya Gupta and solemnized her marriage in the &#8220;Bashukinath&#8221; Temple<br \/>\n         according to Hindu rites and rituals in the presence of the priest and that he<br \/>\n         accepted her as his married wife. For the last few days, she alleged that Bullu<br \/>\n         @ Aditya Gupta in league with his parents started demanding Rs.50,000\/-<br \/>\n         (Fifty thousand) in cash and a motorcycle in kind being the dowry as the<br \/>\n         marriage was solemnized without dowry and in this connection they started<br \/>\n<span class=\"hidden_text\" id=\"span_1\">                                          2<\/span><\/p>\n<p>torture in various ways and finally she was driven out by the accused persons<br \/>\non 29.09.2009 with her daughter with the caution that she would not be<br \/>\naccepted lest she would bring the dowry in cash and kind.\n<\/p>\n<p id=\"p_2\">3.            Upon service of notice, the Opposite Party No.2 put appearance<br \/>\nby executing Vakalatnama but no counter-affidavit has been filed.\n<\/p>\n<p id=\"p_3\">4.            Mr. Purnendu Kumar Jha, learned Counsel appearing for the<br \/>\npetitioner at the outset submitted that the complainant very fairly admitted that<br \/>\nshe was earlier married to one Pankaj Mandal at village Sarwa and without<br \/>\nobtaining a decree of divorce under the <a href=\"\/doc\/590166\/\" id=\"a_4\">Hindu Marriage Act<\/a> she escaped with<br \/>\nBullu @ Aditya Gupta and solemnized marriage in the Temple, which cannot<br \/>\nbe said to be the valid marriage. Second marriage in the life time of the first<br \/>\nhusband without obtaining a decree of divorce is a void marriage having got<br \/>\nno sanction of law, therefore, neither Bullu @ Aditya Gupta would be deemed<br \/>\nto be her husband nor his near relatives would be deemed as the in-laws of<br \/>\nthe complainant and therefore <a href=\"\/doc\/538436\/\" id=\"a_5\">Section 498A<\/a> I.P.C. is not attracted against<br \/>\nthese petitioners, who were none other than near relations of Bullu @ Aditya<br \/>\nGupta.\n<\/p>\n<p id=\"p_4\">5.            <a href=\"\/doc\/445276\/\" id=\"a_6\">Section 498A<\/a> Code of Criminal Procedure is specific, which<br \/>\nspeaks;-\n<\/p>\n<blockquote id=\"blockquote_1\"><p>                   &#8220;whoever, being the husband or the relative of the<br \/>\n             husband for a woman, subjects such woman to cruelty shall<br \/>\n             be punished with imprisonment for a term which may<br \/>\n             extend to three years and shall also be liable to fine.&#8221;\n<\/p><\/blockquote>\n<p id=\"p_5\">6.            In the explanation the cruelty has been defined but since the<br \/>\nprosecution failed to establish the relationship of husband and wife between<br \/>\nthe informant and Bullu @ Aditya Gupta, the near relations of Bullu @ Aditya<br \/>\nGupta cannot be held to be the relatives of the husband of the informant and<br \/>\nso the entire criminal prosecution of the petitioners cannot be sustained under<br \/>\nlaw.\n<\/p>\n<p id=\"p_6\">7.            Learned Counsel appearing on behalf of the informant-Opposite<br \/>\nParty No.2 failed to satisfy this Court that there was valid marriage between<br \/>\nthe informant and Bullu @ Aditya Gupta and that the alleged marriage<br \/>\nbetween them in a Temple was not a void marriage.\n<\/p>\n<p id=\"p_7\">8.            In the facts and circumstances, I find substance in the argument<br \/>\nof the   Counsel appearing for the petitioners that the informant O.P.No.2<br \/>\nfailed to establish that she was legally wedded wife of Bullu @ Aditya Gupta<br \/>\nso as to establish that the petitioners being near relatives of Bullu @ Aditya<br \/>\nGupta were also liable to be criminally proceeded in the instant case.\n<\/p>\n<p id=\"p_8\">9.            For the reasons stated above, I find that the criminal proceeding<br \/>\nof the petitioners cannot be sustained under law and hence their entire<br \/>\ncriminal proceeding in G.R. No.1002 of 2009, arising out of Godda (Town)<br \/>\n<span class=\"hidden_text\" id=\"span_1\">                                             3<\/span><\/p>\n<p>P.S. Case No.295 of 2009 corresponding to T.R.No.1469 of 2009 including<br \/>\nthe order dated 09.10.2009 by which cognizance of the offence was taken<br \/>\nagainst them and others are quashed.\n<\/p>\n<p id=\"p_9\">10.
