None has entered<\/p>\n<p>appearance on their behalf. Respondent no.5 is dead. Respondents No.<\/p>\n<p>6 and 7 could not be served. However, it is common ground that the<\/p>\n<p>respondents other than respondents no. l to 3 are not contesting in<\/p>\n<p>character.\n<\/p>\n<p id=\"p_1\">             The challenge herein is to the validity of the order dated<\/p>\n<p>8.10.2008 vide which the Motor Accident Claims Tribunal, Mukatsar<\/p>\n<p>(hereinafter referred to as &#8220;the Tribunal) allowed the reception of certified<\/p>\n<p>copies of statement of Jagtar Singh and Baldev Singh as Ex. R-5 and Ex.<\/p>\n<p>R-6 respectively into evidence in spite of the fact that they had not been<\/p>\n<p>examined in substantive evidence. Jagtar Singh and Baldev Singh are<br \/>\n<span class=\"hidden_text\" id=\"span_1\"> Civil Revision No.6751 of 2008                                -2-<\/span><\/p>\n<p>                                      ****<\/p>\n<p>otherwise claimants in MACT case No.65 of 26.10.2006.<\/p>\n<p id=\"p_2\">             In support of the finding, the learned Tribunal drew sustenance<\/p>\n<p>from the fact that certified copy of a statement made in the course of<\/p>\n<p>judicial proceedings is admissible in the proceedings before the Tribunal.<\/p>\n<p>In that context, the Tribunal also noticed that the rules of procedure and<\/p>\n<p>provisions of law of evidence&#8221;are not to be complied with strictly in a claim<\/p>\n<p>petition under the <a href=\"\/doc\/785258\/\" id=\"a_1\">Motor Vehicle Act<\/a>.&#8221;.\n<\/p>\n<p id=\"p_3\">             The view is plainly indefensible and unsustainable. In view of<\/p>\n<p>the conceded position that Jagtar Singh and Baldev Singh are claimants in<\/p>\n<p>the petition and they did not enter the witness box, the reception of their<\/p>\n<p>statements which they made in Criminal Case FIR No.9 dated 19.4.1996<\/p>\n<p>under <a href=\"\/doc\/1270101\/\" id=\"a_1\">Sections 279<\/a>\/<a href=\"\/doc\/1371604\/\" id=\"a_2\">304-A<\/a> IPC, Police Station, GRP Abohar pertaining to<\/p>\n<p>the impugned accident, would be illogical. When witnesses are alive and<\/p>\n<p>amenable to the jurisdiction of the Court, the law would not entertain a<\/p>\n<p>request for tendering of their statements (recorded before the Criminal<\/p>\n<p>Court) into evidence. If the reception of such like statements is allowed,<\/p>\n<p>the parties opposite shall, obviously, have no opportunity to cross examine<\/p>\n<p>them. The view obtained by the learned Tribunal is not in accord with law.<\/p>\n<p id=\"p_4\">             The petition shall stand allowed accordingly. The impugned<\/p>\n<p>order shall stand set aside.\n<\/p>\n<p id=\"p_5\">             The stay order dated 5.12.2008 shall stand vacated.
