APP (SJ) No.430 of 2011\n                                    SHANKAR SAH\n                                           Versus\n                                THE STATE OF BIHAR\n                                         -----------\n<\/pre>\n<p id=\"p_1\">2.   18.4.2011             This appeal shall be heard.\n<\/p>\n<p id=\"p_1\">                               Call for the lower court records.\n<\/p>\n<p id=\"p_2\">                               Heard Shri Akhileshwar Prasad Singh, learned<\/p>\n<p>                 Senior counsel for the appellant and Shri S.N.Prasad, learned<\/p>\n<p>                 A.P.P. for the State on the prayer for bail of the appellant.<\/p>\n<p id=\"p_3\">                               It was contended by learned Senior counsel<\/p>\n<p>                 appearing on behalf of the appellant that the age of the victim<\/p>\n<p>                 has been assessed by the Doctor in between 17-18 years and the<\/p>\n<p>                 medical opinion further indicates as if she was carrying a fetus<\/p>\n<p>                 of two months in her womb. She was alleging being taken by the<\/p>\n<p>                 appellant from Katihar to different places and being ravished at<\/p>\n<p>                 all places. The contention is that the very medical finding and<\/p>\n<p>                 the conduct of the lady in the light of her age probabablises<\/p>\n<p>                 herself to be a consenting party.\n<\/p>\n<p id=\"p_4\">                               Regard being had to the contentions, let the<\/p>\n<p>                 appellant Shankar Sah be directed to be released, during<\/p>\n<p>                 pendency of this appeal, on furnishing a bond of Rs. 10,000\/-<\/p>\n<p>                 (ten thousand) with two sureties of the like amount each to the<\/p>\n<p>                 satisfaction of the trial court, i.e., the Sessions Judge, Katihar, in<\/p>\n<p>                 Sessions Trial No. 69 of 2010.\n<\/p>\n<p id=\"p_5\">                               As regards sentence of fine, realisation thereof<\/p>\n<p>                 against the appellant shall remain stayed till further orders.<\/p>\n<pre id=\"pre_1\">        Kanth                                           ( Dharnidhar Jha, J.)\n <\/pre>\n","protected":false},"excerpt":{"rendered":"<p>Patna High Court &#8211; Orders Shankar Sah vs The State Of Bihar on 18 April, 2011 IN THE HIGH COURT OF JUDICATURE AT PATNA CR.
