No. 137 OF 2009\n                  --------------------------------------------\n                 Dated this the 25th day of June, 2009\n\n                               JUDGMENT\n<\/pre>\n<p id=\"p_1\">Ramachandran Nair,J.\n<\/p>\n<p id=\"p_1\">\n<p id=\"p_2\">      Since the Supreme Court has rendered judgments on the same<\/p>\n<p>issue after Tribunal issued the impugned order in appeal, and since the<\/p>\n<p>matter relates to computation of eligible deduction of export profit, we<\/p>\n<p>set aside the order of the Tribunal and remand the matter to the<\/p>\n<p>assessing officer to recompute eligible deduction for the assessee under<\/p>\n<p>Section 80HHC of the Act, following the decisions of the Supreme<\/p>\n<p>Court in <a href=\"\/doc\/81090\/\" id=\"a_1\">CIT V. K. RAVINDRANATHAN NAIR<\/a>, 295 I.T.R. 228 and<\/p>\n<p><a href=\"\/doc\/1887686\/\" id=\"a_1\"><a href=\"\/doc\/1569253\/\" id=\"a_2\">IPC<\/a>A LABORATORY LTD. V. CIT<\/a>, 266 I.T.R. 521.                      Since we<\/p>\n<p>disposed of the case without issuing notice to the assessee, the<\/p>\n<p>assessing officer will issue notice along with a copy of this judgment<\/p>\n<p>and give an opportunity to the assessee to file statement of claims based<\/p>\n<p>on the decisions of the Supreme Court, particularly those referred<\/p>\n<p>above and pass fresh orders.\n<\/p>\n<p id=\"p_3\">      Appeal is disposed of as above.\n<\/p>\n<p id=\"p_4\">                                         (C.N.RAMACHANDRAN NAIR)<br \/>\n                                                            Judge.\n<\/p>\n<p id=\"p_5\">                                                (C.
