NO. 4141   OF 2008\n          ===========================\n\n    Dated this the 27th day of January,2009\n\n                     ORDER\n<\/pre>\n<p id=\"p_1\">    Revision  petitioner  is   challenging  the<\/p>\n<p>order passed by Judicial First Class Magistrate<\/p>\n<p>II,  Kottarakkara   dismissing  C.M.P.7288\/2008<\/p>\n<p>filed by him under <a href=\"\/doc\/768169\/\" id=\"a_1\">section 451<\/a> of the Code of<\/p>\n<p>Criminal  Procedure  for   interim  custody  of<\/p>\n<p>autorickshaw    KL-2N  6145   seized  in  Crime<\/p>\n<p>No.459\/2008 of Pooyappally Police Station and<\/p>\n<p>produced before the court.   Learned Magistrate<\/p>\n<p>dismissed the petition as the application was<\/p>\n<p>opposed by the Assistant Public Prosecutor on<\/p>\n<p>the  ground  that  the   stolen  articles  were<\/p>\n<p>transported  in   the   autorikshaw   and   the<\/p>\n<p>autorikshaw is to be shown and identified in<\/p>\n<p>the course of investigation and therefore it<\/p>\n<p>cannot be released to the revision petitioner.<\/p>\n<p id=\"p_1\">    2.    Learned  counsel  appearing  for  the<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">CRRP 4141\/2008             2<\/span><\/p>\n<p>revision      petitioner and  the   learned   Public<\/p>\n<p>Prosecutor were heard.\n<\/p>\n<p id=\"p_2\">     3. Learned counsel   submitted that there is no<\/p>\n<p>necessity to retain the autorikshaw so as to cause<\/p>\n<p>damage to the vehicle by exposing to sun    and rain<\/p>\n<p>and revision petitioner is prepared to abide by any<\/p>\n<p>condition and therefore the order is to be quashed<\/p>\n<p>and interim custody is to be granted.        Learned<\/p>\n<p>Public Prosecutor submitted that out of the four<\/p>\n<p>accused involved accused 1 to 3 are yet to be<\/p>\n<p>apprehended and for proper investigation of the<\/p>\n<p>case, custody of the vehicle is necessary and<\/p>\n<p>learned Magistrate rightly dismissed the petition.<\/p>\n<p id=\"p_3\">     4. The prosecution case is that on 20.9.2008 at<\/p>\n<p>about 3 a.m the accused in Crime No.459\/2008 break<\/p>\n<p>opened the room and committed theft of 200    rubber<\/p>\n<p>sheets and 85 kg. of latex of rubber     and thereby<\/p>\n<p>caused a loss of Rs.19,000\/- to the de facto<\/p>\n<p>complainant and after the theft the stolen articles<\/p>\n<p>were transported in autorikshaw KL-2N 6145 which<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">CRRP 4141\/2008             3<\/span><\/p>\n<p>was seized by the police and produced before the<\/p>\n<p>Magistrate.       Even  if  it  is  taken  that   the<\/p>\n<p>autorikshaw was used for transporting the stolen<\/p>\n<p>articles, I do not find it necessary to retain the<\/p>\n<p>custody of the vehicle so as to cause damage to the<\/p>\n<p>vehicle.      If the case of the prosecution is that<\/p>\n<p>the vehicle is to be shown to the    witnesses and is<\/p>\n<p>to be identified , there could be a direction to<\/p>\n<p>the revision petitioner to produce the vehicle to<\/p>\n<p>enable     the  Investigating   Officer  to  get   it<\/p>\n<p>identified.\n<\/p>\n<p id=\"p_4\">     5. In such circumstance, the order passed by<\/p>\n<p>the    Magistrate in CMP 7288\/2008 dated 29.10.2008<\/p>\n<p>is set aside.     The  Magistrate is directed to give<\/p>\n<p>interim custody of the vehicle to the revision<\/p>\n<p>petitioner who is the R.C owner of the vehicle on<\/p>\n<p>the following conditions.     (1) Revision petitioner<\/p>\n<p>shall execute a bond for Rs.30,000\/- with two<\/p>\n<p>solvent      sureties for   the  like   sum  to   the<\/p>\n<p>satisfaction of the Judicial First Class Magistrate<\/p>\n<p><span class=\"hidden_text\" id=\"span_2\">CRRP 4141\/2008             4<\/span><\/p>\n<p>Kottarakkara undertaking to produce the vehicle as<\/p>\n<p>and when directed.
