Kodekar, learned APP, appears and waives service of notice of<br \/>\nRule on behalf of  the respondent &#8211; State of Gujarat.\n<\/p>\n<p id=\"p_3\">3\tHaving<br \/>\nregard to the facts of the case,  the application is taken up for<br \/>\nhearing today.\n<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">4\t<\/span><\/p>\n<p id=\"p_4\">The applicant-convict prisoner, who vide judgment and order dated<br \/>\n18.7.2007, rendered in Sessions Case No.28 of 2007, by the learned<br \/>\nAdditional Sessions Judge, Himatnagar, has been convicted for the<br \/>\noffences punishable under Sections 302 etc,<a href=\"\/doc\/1569253\/\" id=\"a_1\">  of the Indian Penal Code<\/a><br \/>\nand sentenced to imprisonment for life, has filed this Application,<br \/>\nthrough jail authority, praying to enlarge him on temporary bail, for<br \/>\na period of 21 days, to enable him to attend  obsequious ceremony of<br \/>\nhis mother who has died on 21.10.2010 <\/p>\n<p>5\tHaving<br \/>\nconsidered the submission advanced by Mr. R.C. Kodekar, learned APP<br \/>\nfor the respondent-State of Gujarat and  a perusal of the<br \/>\naverments made in the application so also the jail remarks sheet<br \/>\nforwarded by the jail authority along with the application,  we have<br \/>\nnoticed that the applicant has enjoyed temporary bail for a period of<br \/>\n14 days  w.e.f. 23.12.2010 to 5.1.2011 and  his mother  has also died<br \/>\n on 6.10.2010, we are not inclined to release the applicant on<br \/>\ntemporary bail, on the grounds stated by him in the application.\n<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">6\t<\/span><\/p>\n<p id=\"p_5\"> Seen in the above context, instant application lacks merit and<br \/>\ndeserves to be rejected.\n<\/p>\n<p id=\"p_6\">7\tFor<br \/>\nthe foregoing reasons,  the Application fails and according it is<br \/>\nrejected.
