An application was submitted before<br \/>\nthe petitioner-Society seeking certain information under the<br \/>\nprovisions of the <a href=\"\/doc\/671631\/\" id=\"a_3\">RTI Act<\/a>.\n<\/p>\n<p id=\"p_2\">3.\t\tIt<br \/>\nis the case of the petitioner that a co-operative society, registered<br \/>\nunder the provisions of the Gujarat Co-operative Societies Act, is<br \/>\nnot a &#8216;public authority&#8217; within the meaning of <a href=\"\/doc\/1097458\/\" id=\"a_4\">Section 2(h)<\/a> of<br \/>\nthe RTI Act and therefore, the provisions of the <a href=\"\/doc\/671631\/\" id=\"a_5\">RTI Act<\/a> would not<br \/>\napply to it. However, vide impugned orders, respondent no.1-authority<br \/>\nheld that the co-operative societies were covered under the<br \/>\nprovisions of the <a href=\"\/doc\/671631\/\" id=\"a_6\">RTI Act<\/a>  and  consequently, directed the petitioner<br \/>\nto supply the information sought for.\n<\/p>\n<p id=\"p_3\">4.\t\tBeing<br \/>\naggrieved by the same, the petitioner-society has preferred the<br \/>\npresent petition under <a href=\"\/doc\/1712542\/\" id=\"a_7\">Article 226<\/a> of the Constitution of India.\n<\/p>\n<p id=\"p_4\">5.\t\tHeard<br \/>\nlearned counsel for the respective parties and perused the documents<br \/>\non record. It is the case of the petitioner that being a co-operative<br \/>\nsociety, duly registered under the provisions of the Gujarat<br \/>\nCo-operative Societies Act, 1961, it would not fall within the<br \/>\ndefinition of &#8216;public authority&#8217;, as defined u\/s. 2(h) of the<br \/>\n<a href=\"\/doc\/671631\/\" id=\"a_8\">RTI Act<\/a>. <a href=\"\/doc\/1097458\/\" id=\"a_9\">Section 2(h)<\/a> of the said Act reads as under;\n<\/p>\n<p id=\"p_5\"> 2(h).\t  Public<br \/>\nAuthority  means any authority or body or institution of<br \/>\nself-government established or constituted,-\n<\/p>\n<p id=\"p_6\">(a)\tby<br \/>\nor under the Constitution;\n<\/p>\n<p id=\"p_7\">(b)\tby<br \/>\nany other law made by Parliament;\n<\/p>\n<p id=\"p_8\">(c)\tby<br \/>\nany other law made by State Legislature;\n<\/p>\n<p id=\"p_9\">(d)\tby<br \/>\nnotification issued or order made by the appropriate \tGovernment, and<br \/>\nincludes any  <\/p>\n<p id=\"p_10\">\t(i)\tbody<br \/>\nowned, controlled or substantially \tfinanced;\n<\/p>\n<p id=\"p_11\">\t(ii)\tnon-Government<br \/>\nOrganization substantially \tfinanced,<\/p>\n<p>directly<br \/>\nor indirectly by funds provided by the appropriate Government;\n<\/p>\n<p id=\"p_12\">6.\t\tLooking<br \/>\nto the peculiar facts and circumstances of the case and the<br \/>\ndefinition as contained in <a href=\"\/doc\/1097458\/\" id=\"a_10\">Section 2(h)<\/a> of the RTI Act, I am of the<br \/>\nopinion that it would be appropriate that the competent authority<br \/>\ndecides the issue as to whether the petitioner   co-operative<br \/>\nsociety would fall within the definition of <a href=\"\/doc\/1097458\/\" id=\"a_11\">Section 2(h)<\/a> of the RTI<br \/>\nAct or not, after giving proper opportunity to the petitioner to<br \/>\ndefend its case.\n<\/p>\n<p id=\"p_13\">7.\t\tHence,<br \/>\nthe impugned orders passed by respondent no.1-authority is quashed<br \/>\nand set aside. The matter is remanded to the competent authority of<br \/>\nthe Gujarat State Information Commission for decision on the issue as<br \/>\nto whether the petitioner   co-operative society is covered under<br \/>\nthe provisions of the <a href=\"\/doc\/671631\/\" id=\"a_12\">RTI Act<\/a> or not, in pursuance of the decision of<br \/>\nthis Court in Agricultural Produce Market Committee, Unjha&#8217;s<br \/>\ncase.\n<\/p>\n<p id=\"p_14\">8.\t\tIt<br \/>\nis clarified that this Court has passed the aforesaid order, without<br \/>\nentering into the merits of the case and therefore, the competent<br \/>\nauthority shall decide the issue on merits, after considering the<br \/>\naspect of administrative control under the relevant Bye-laws and<br \/>\nRules of the society.\n<\/p>\n<p id=\"p_15\">9.\t\tWith<br \/>\nthe above observations, the petition stands disposed of.
