Justice ANTONY DOMINIC\n\n Dated :16\/12\/2009\n\n O R D E R\n                       ANTONY DOMINIC, J.\n              --------------------------------------------------\n                  W.P.(C) NO.34098 OF 2003 (H)\n              --------------------------------------------------\n        Dated this the 16th day of December, 2009\n\n                           J U D G M E N T\n<\/pre>\n<p id=\"p_1\">     Petitioners joined the service as Police Constables in Armed<\/p>\n<p>Police. They earned promotion as Havildars. Subsequently, on the<\/p>\n<p>request made by the petitioners, they were transferred to Armed<\/p>\n<p>Reserve, where they were later promoted as Head Constable. The<\/p>\n<p>claim of the petitioners is that while reckoning their eligibility for<\/p>\n<p>the 2nd time bound higher grade, their service from the date of<\/p>\n<p>promotion as Havildars in the Armed Police,                 should also be<\/p>\n<p>reckoned. This claim was made and was rejected by Ext.P5. It is<\/p>\n<p>challenging Ext.P5 that this writ petition is filed.<\/p>\n<p id=\"p_1\">     2. Counsel for the petitioner relied on Ext.P3 Government<\/p>\n<p>Order dated 24.11.99 which provides that the service rendered by<\/p>\n<p>persons like the petitioners in Armed Battalion or Armed Reserve,<\/p>\n<p>will together be reckoned for awarding first time bound higher<\/p>\n<p>grade. It is stated that if so they should get the credit of services<\/p>\n<p>in the Armed Police even if they              are transferred to Armed<\/p>\n<p>Reserve, for awarding the 2nd time bound higher grade.<\/p>\n<p>WPC.No.34098 \/03<br \/>\n<span class=\"hidden_text\" id=\"span_1\">                                  :2 :<\/span><\/p>\n<p id=\"p_2\">     3.    Paragraph 6 of the counter affidavit filed by the<\/p>\n<p>respondents reads as under.\n<\/p>\n<blockquote id=\"blockquote_1\"><p>              &#8220;Even though the promotion posts of Havildar in KAP<\/p>\n<p>              4th Battalion and Head Constables in Armed Reserve,<\/p>\n<p>              Kannur are identical in pay scales and nature of duty,<\/p>\n<p>              they were transferred to Armed Reserve at their<\/p>\n<p>              request only. In the transfer order itself it was clearly<\/p>\n<p>              mentioned that they will be reverted as Police<\/p>\n<p>              Constable, if no vacancy is available in the Armed<\/p>\n<p>              Reserve for absorbing them in the rank held in the<\/p>\n<p>              Battalion. But as there was no vacancy of Head<\/p>\n<p>              Constables in Armed Reserve, Kannur at that time<\/p>\n<p>              they were reverted as Police Constables and their<\/p>\n<p>              chance to continue in the post of Havildar\/Head<\/p>\n<p>              Constable was lost. As per the option submitted by<\/p>\n<p>              the petitioners, they have no right to claim the<\/p>\n<p>              promoted period to count      for second time bound<\/p>\n<p>              grade. Now all the petitioners were given the benefit<\/p>\n<p>              of II nd time bound Higher Grade after completion of<\/p>\n<p>              8 years service in the promoted post from the Armed<\/p>\n<p>WPC.No.34098 \/03<br \/>\n<span class=\"hidden_text\" id=\"span_1\">                                    :3 :<\/span><\/p>\n<p>              Reserve.&#8221;<\/p><\/blockquote>\n<p id=\"p_3\">\n<p id=\"p_4\">      4. From this it is evident that at the time when they opted<\/p>\n<p>for transfer to Armed Reserve petitioners agreed to forgo their<\/p>\n<p>promotion in the Armed Battalion, if no vacancy was avaklable to<\/p>\n<p>accommodate them. As no vacancy was available in the Armed<\/p>\n<p>Reserve     for absorbing them in the rank they          held in the<\/p>\n<p>Battalion, they were recruited and absorbed as Police Constables.<\/p>\n<p>If so, their eligibility for the second time higher grade can only be<\/p>\n<p>reckoned from the date they earned              promotion as Head<\/p>\n<p>Constables in the Armed Reserve.\n<\/p>\n<p id=\"p_5\">      5. Learned Counsel for the petitioners referred me to G.O<\/p>\n<p>(P)1041\/79(142) fin. dated 27.11.79 and contended that even in<\/p>\n<p>respect of inter district transferees, on their absorption as junior<\/p>\n<p>most in the transferred District, the period spent by them before<\/p>\n<p>transfer is reckoned for time bound higher grade. However, such<\/p>\n<p>cases do not involve any reversion as in this case and if so the<\/p>\n<p>case of the petitioner cannot be compared to the case dealt with<\/p>\n<p>in the Government Order dated 7.11.2078 relied on by the<\/p>\n<p>learned counsel for the petitioner.\n<\/p>\n<p id=\"p_6\">WPC.No.34098 \/03<br \/>\n<span class=\"hidden_text\" id=\"span_2\">                                  :4 :<\/span><\/p>\n<p id=\"p_7\">      6.   Counsel   for the petitioners placed reliance on     the<\/p>\n<p>Government Order dated 28.11.81 which according to her<\/p>\n<p>provides reckoning of service rendered in different posts having<\/p>\n<p>identical time scales of     pay for eligibility for reckoning time<\/p>\n<p>bound higher grade. The scale of pay of Havildar or Head<\/p>\n<p>Constable cannot be identical as that of Police Constable and in<\/p>\n<p>that view of the matter the benefit of this Government Order<\/p>\n<p>cannot be granted. Further, grant of time bound higher grade can<\/p>\n<p>be only as per the terms of the order providing for the same.<\/p>\n<p>Petitioners have no case that the order providing for the benefits<\/p>\n<p>claimed by them.\n<\/p>\n<p id=\"p_8\">      7.
